| المستخلص: | يتناول هذا البحث بيان مسألة من المسائل المستجدة بعنوان: (الرد بالعيب وتطبيقاته في البيوع الإلكترونية دراسة فقهية تطبيقية)، وذلك بذكر صور العيب في التجارة الإلكترونية وبيان أحكامها من خلال الرجوع إلى مصادر الشريعة، وأقوال الفقهاء وتنزيلها على تلك الصور الجديدة وتطبيقها عليها). والبحث مشتمل على مقدمة، وتمهيد، ومبحثين، وخاتمة. أما المقدمة: فيها بيان أهمية البحث، وأسباب اختياره، والدراسات السابقة. والمبحث الأول في التعريف بمفردات العنوان. والمبحث الثاني: في بيان شروط الرد بالعيب. والمبحث الثالث: العيب في التجارة الإلكترونية والرد بها. والمنهج الذي سرت عليه هو المنهج الوصفي، وذلك باختيار عدد من المسائل المتعلقة بخيار الرد بالعيب، وذكر أقوال الفقهاء فيها، ثم ذكر تطبيقات وأمثلة من البيوع الإلكترونية. وأهم النتائج المتوصلة إليها من خلال البحث: أن المبيع في التجارة الإلكترونية إذا كان به عيب قديم حدث قبل تسليم المبيع إلى المشتري، فإنه يرد به، والعيب الذي يحدث عند نقل السلعة، هو من البائع أن كان الناقل تابعا له، ومن المشتري أن كان الناقل تابعا له. This research addresses the explanation of a new issue, titled: (A Product Return Due to Defect in Electronic Sales: An Applied Jurisprudential Study), this was done by mentioning the manifestations of defects in electronic trade and an explanation of their rulings through a recourse to the sources of the Shari’ah, the sayings of the jurists, and relating them to those new manifestations with application. The research is made up of an introduction, a preface, two topics and a conclusion. As for the Introduction: it contains an explanation of the importance of the research, the reasons for choosing it, and the literature review. The first topic: on the definition of the words contained in the topic. The third topic: on defects in electronic trade and product return due to it. The methodology followed by the researcher is the descriptive, this was done by selecting a number of issues related to the choice of product return due to defect, and the mention of the opinions of the jurists regarding it, them mentioning the applications and examples of electronic sales. The most significant findings of the research include: That if a product in electronic trade has an old defect which has been with it before it was sent to the buyer, then it can be returned with it, as for the defect that happens when the product is being transported, it follows the seller if the means of transport was initiated by him, and it follows the buyer if the means of transportation was initiated by him. |
