| 520 | |a تعتبر منطقة التجارة الحرة القارية الإفريقية (ZLECAF) أحد المشاريع الرئيسية التي أطلقها الاتحاد الإفريقي، وهذا بعد استكمال نصاب تصديقات الدول الإفريقية ودخول الاتفاقية حيز النفاذ، وقد جاءت ضمن جدول أعمال " الأجندة الإفريقية لعام، 2063 حيث تهدف الاتفاقية إلى زيادة التجارة البينية بين الدول الأعضاء وتعزيز القدرة التنافسية للصناعة في إفريقيا من خلال إزالة الحواجز الجمركية وغير الجمركية، كما أن نجاح تجسيدها سيعود بالفائدة على التنمية الاقتصادية في إفريقيا بصفة عامة، وخطوة أساسية نحو إنشاء سوق أفريقية مشتركة وإصدار عملة موحدة وذلك طبقا لاتفاقية أبوجا والمعاهدة التأسيسية للاتحاد الإفريقي، كان من أوائل إنجازات المفاوضات بشأن منطقة التجارة الحرة القارية الأفريقية اعتماد البروتوكول المتعلق بالقواعد والإجراءات لتسوية المنازعات. وقد تم الاتفاق على هذا الأخير خلال المرحلة الأولى من مفاوضات منطقة التجارة الحرة القارية الأفريقية، وكذلك البروتوكول المتعلق بالتجارة في السلع والتجارة في الخدمات. وقد استكمل مؤخرا بإضافة النظام الداخلي لهيئة تسوية المنازعات التابعة لمنطقة التجارة الحرة القارية الأفريقية، فضلا عن قرار بإنشاء هيئة الاستئناف رسميا والنظر في استكمال الترشيحات المقدمة من الدول الأطراف إلى قائمة الخبراء المؤقتة. أن بروتوكول تسوية المنازعات هو أداة مفصلة تسمح بتسوية النزاعات بين الدول الأطراف فيما يتعلق بتفسير أو تطبيق أي من النصوص القانونية لمنطقة التجارة الحرة القارية الأفريقية. ويكرر التصميم العام لهذا النظام تصميم منظمة التجارة العالمية. ولكنه يتضمن أيضا عناصر فريدة تناقش هذه الورقة السمات الرئيسية لآلية تسوية المنازعات في منطقة التجارة الحرة القارية الأفريقية وبعض الآثار المترتبة على الحكامة التجارية. وإذا غيرت آلية تسوية المنازعات هذه النهج التقليدي فيما بين البلدان الأفريقية إزاء تسوية المنازعات المتعلقة بالمسائل التجارية، فإنها يمكن أن تؤدي إلى تغييرات كبيرة في الحكامة التجارية في القارة. |b One of the first achievements of the negotiations on the African Continental Free Trade Area (AfCFTA) was the adoption of the Protocol on Rules and Procedures for the Settlement of Disputes. The latter was agreed in Phase I of the AfCFTA negotiations, as were the protocols on trade in goods and trade in services. It was recently supplemented by the addition of rules of procedure for the FTA Dispute Settlement Body and a decision to formally establish the Appellate Body and to consider an update of the nominations of States Parties to the Indicative List of Experts. The Dispute Settlement Protocol is a detailed instrument for the settlement of disputes between States parties concerning the interpretation or application of any of the legal instruments of the AfCFTA. The general concept of this regime reproduces that of the World Trade Organization (WTO), but it also contains unique elements. This paper discusses the key features of the AFCFTA dispute settlement mechanism and some of the implications for commercial governance. If this dispute settlement mechanism changes the traditional intra-African approach to trade dispute settlement, it could lead to major changes in the continent's trade governance. |d L'une des premières réalisations des négociations sur la Zone de libre-échange continentale africaine a été l'adoption du Protocole sur les Règles et procédures relatives au règlement des différends. Ce dernier a été convenu au cours de la phase I des négociations de la ZLECAf, de même que le protocole sur le commerce des marchandises et celui sur le commerce des services. Il a été récemment complété par l'ajout d'un règlement intérieur pour l'Organe de règlement des différends de la ZLECAf ainsi qu’une décision visant à créer officiellement l'Organe d'appel et à examiner une mise à jour des candidatures des États parties à la Liste indicative des experts. Le Protocole de règlement des différends est un instrumentum détaillé qui permet le règlement des différends entre les États parties concernant l'interprétation ou l'application de l'un quelconque des instruments juridiques de la ZLECAf. La conception générale de ce régime reproduit celle de l'Organisation mondiale du commerce (OMC), mais il contient également des éléments uniques. Le présent document traite des principales caractéristiques du mécanisme de règlement des différends de la ZLECAf et de certaines des implications pour la gouvernance commerciale. Si ce mécanisme de règlement des différends modifie l'approche traditionnelle intra-africaine en ce qui concerne le règlement des différends relatifs aux questions commerciales, il pourrait entraîner des changements majeurs dans la gouvernance commerciale du continent. | ||
