| 520 | |a إن مجال حقوق الملكية الفكرية من المجالات التي شهدت تضافراً ولسنوات طويلة بين جهود جميع دول العالم، لأن الاختراع والإبداع لا يمكن أن يزدهرا، وأن ينتج عنهما منتج تسويقي إذا لم يتحقق بناء نظام قانوني قوي يحميه، ولأهمية ذلك فقد تناولت الدراسة بعض المفاهيم الأساسية في حقوق الملكية الفكرية والمصنفات الرقمية، وركزت في المقام الأول على القوانين والتشريعات المتعلقة بحماية حقوق الملكية الفكرية في البيئة الرقمية ومنها قانون DMCA، وجرى تسليط الضوء على الإجراءات التقنية لحماية الملكية الفكرية في البيئة الرقمية بالتركيز على تقنية البلوكتشين التي وفرت حماية تقنية متميزة للإبداعات والمؤلفات وغيرها، مروراً بعرض قوانين حقوق الملكية الفكرية في سورية وانتهاءً بتحديد مدى مواكبتها للتطورات التشريعية والتقنية لاسيما البلوكتشين بالاعتماد على منهج دراسة الحالة، وقد توصلت الدراسة إلى جملة من النتائج ومن أبرزها ضعف مواكبة التطورات التشريعية، لاسيما المتعلقة بحماية حقوق المؤلف في البيئة الرقمية من جهة، وعدم الاعتماد على تقنية البلوكتشين من جهة ثانية. |b The field of intellectual property rights is one of the areas that have witnessed concerted efforts for many years between the efforts of all countries of the world because invention and creativity cannot flourish and result in a marketing product if a strong legal system is not built to protect it, and for the importance of this, the study dealt with some basic concepts in intellectual property rights and works Digital, and focused mainly on laws and legislation related to the protection of intellectual property rights in the digital environment, including the DMCA law, and the technical procedures for protecting intellectual property in the digital environment were also highlighted by focusing on blockchain technology, which provided distinct technical protection for creativity, literature, and others.
