| المستخلص: | إن الوسيلة القانونية المتمثلة بالقرارات الإدارية الإلكترونية قد جاءت نتيجة التطور والتقدم في الوسائل الإلكترونية والثورة التكنولوجية التي من خلالها تقوم مؤسسات وإدارات الدولة بأعمالها من أجل تقديم أفضل الخدمات وتوفير الوقت والجهد ولذلك لابد من إعطاء هذه القرارات وعاءا قانونيا واضحا وخاصا بها يبين كيفية إصدارها والحصول عليها مع إضافة الحماية القانونية لها ولذلك قامت هذه الدراسة ببحث الضوابط القانونية للقرارات الإدارية الإلكترونية، بشكل يجعلها متفقة مع أساسيات القرارات الإدارية التقليدية التي رسخها الفقه والقضاء الإداري على مر العصور، وحتى لا يكون هناك مساس من الناحية القانونية بصحة وسلامة هذه القرارات. The legal means of electronic administrative decisions has come as a result of the development and progress in electronic means, and the technological revolution through which state institutions and administrations carry out their work, in order to provide the best services and save time and effort. How to issue and obtain it, with the addition of legal protection to it. Therefore, this study examined the legal controls for electronic administrative decisions And identifying them, through dealing with their definitions and clarification, and explaining their characteristics, in addition to examining the formal and objective elements of this type of decisions, all in order to issue these decisions. In a way that makes it consistent with the basics of traditional administrative decisions that have been established by jurisprudence and administrative judiciary throughout the ages, and so that there is no legal prejudice to the validity and integrity of these decisions. |
