| 520 | |b Rarely has the relationship between law and mathematics given rise to so many problematics and questions as in recent years. In fact, the emergence of the use of smart contracts on the blockchain could affect the contractual settlement between economic actors and consumers. Blockchain technology affects many areas in the business world. It is a question of defining the contours of its mode of operation and its characteristics that bring innovation, and then adress the legal and technical issues that impact legal intermediaries. The example of smart contracts being without doubt the best illustration. It is necessary to specify that it is not the technology that we are trying to regulate but its uses. |d Rarement le rapport entre le droit et les mathématiques aura suscité autant de problématiques et d’interrogations que depuis ces dernières années. En effet, l’émergence de l’utilisation des smart contracts sur la blockchain pourrait remettre en cause l’équilibre contractuel entre les acteurs économiques et les consommateurs. La technologie de la blockchain touche plusieurs domaines dans le monde des affaires. Il s’agit de tracer les contours de son mode de fonctionnement et ses caractéristiques porteurs d’innovation, pour ensuite soulever les problématiques juridiques et techniques qui impactent les intermédiaires de droit, l’exemple des smart contracts en étant sans doute la meilleure illustration. Il est nécessaire de souligner que ce n’est pas la technologie que nous cherchons à encadrer mais ses usages. | ||
