| المستخلص: | تناولت هذه الدراسة أساس المسؤولية المدنية عن حوادث المصاعد الكهربائية، وذلك في مبحثين، تناول الأول منهما المسؤولية المدنية عن حوادث المصاعد الكهربائية مسؤولية تعاقدية، وتناول المبحث الثاني المسؤولية عن حوادث المصاعد الكهربائية مسؤولية تقصيرية، وقد توصلت الدراسة إلى أن أساس المسؤولية المدنية الناشئة عن حوادث المصاعد الكهربائية تقوم على أساس المسؤولية عن الأشياء وهي المسؤولية القائمة على الخطأ المفترض ذلك لأن المصعد الكهربائي يعد من الأشياء التي تتطلب حراستها عناية خاصة. وبالتالي يكون لمضرور إقامة الدعوى على حارس المصعد الكهربائي، وكل ما يلتزم به المضرور هو إثبات أن المصعد هو السبب في الحادث وأن الدور الذي لعبه المصعد في الحادث دور إيجابي وليس سلبيا وإلا انعدمت المسؤولية. This study dealt with the basis of civil liability for accidents of electric elevators, in two sections, the first of which dealt with civil liability for accidents of electric elevators contractual liability, and the second section dealt with liability for accidents of electric elevators tort liability, the study has found that the basis of civil liability arising from accidents of electric elevators is based on the basis of responsibility for things, which is responsibility based on the error assumed because the electric elevator is one of the things that require guarding special care. Thus, the injured party may file a lawsuit against the guard of the electric elevator, and all that the injured party is obligated to do is to prove that the elevator is the cause of the accident and that the role played by the elevator in the accident is a positive role and not negative, otherwise there is no responsibility. |
