| المستخلص: | تعد المصالحة الجزائية في جريمة الصرف إحدى أهم بدائل الدعوى العمومية، فهي تهدف بالدرجة الأولى إلى إعطاء فرصة للمتهم من أجل التصالح مع الإدارة مقابل مبلغ مالي يدفع للخزينة العمومية، فضلا على أنها تساهم في الحد من الاستعمال المفرط لسلاح الدعوى العمومية من أجل اقتضاء حق الدولة في العقاب. ولقد نص المشرع الجزائري على هذا النظام بموجب الأمر رقم 96/22 المعدل والمتمم، المتضمن قمع مخالفة التشريع والتنظيم الخاصين بالصرف وحركة رؤوس الأموال من وإلى الخارج، حيث ضبط هذا الأمر ضوابط إجرائها والأحكام المترتبة عنها بشكل يعكس ذاتية وخصوصية هذا الإجراء مقارنة بغيره من البدائل الإجرائية الأخرى. فالمصالحة كنظام إجرائي تعزز فكرة التحول من العدالة القمعية إلى العدالة التصالحية التي تعد إحدى مرتكزات السياسة العقابية في الوقت الحاضر. The criminal reconciliation in the exchange crime is one of the most important alternatives to the public lawsuit. It aims primarily to give an opportunity to the accused in order to reconcile with the administration in return for a sum of money paid to the public treasury, in addition to that it contributes to limiting the excessive use of the weapon of the public lawsuit in order to require the right of the state to punishment.
