| 520 | |a انتشرت خلال العقدين الأخيرين ظاهرة الإساءة إلى المقدسات الدينية والإستخفاف بها وخاصة منها مقدسات المسلمين ورموزهم، وتنامت مختلف أشكال التعصب الديني ومعاداة الإسلام والسخرية من المعتقدات وأصبحت تمثل إنتهاكات جسيمة لحقوق الإنسان والحريات الأساسية وتهديدات خطيرة للأمن والسلم الدوليين. في هذا الإطار يأتي هذا البحث ليطرح إشكالية الحدود بين حرية الرأي والتعبير وعدم الإساءة للمقدسات وموقف القانون الدولي منها وذلك من خلال إستعراض مختلف مظاهر إنتهاك حرمة المقدسات الدينية وآثارها وبيان مدى الجهود الدولية في ضبط التوازن بين حماية المقدسات الدينية وضمان الحريات. وتوصلت الدراسة إلى عدد من النتائج والتوصيات منها دعوة المنظمات الدولية إلى تفعيل المواثيق والقوانين المبينة للحدود الفاصلة بين حرية الرأي والتعبير والتجاوزات الناتجة عن التعسف في إستغلال هذه الحرية من أجل الإساءة إلى الأديان. |b During the last two decades, the phenomenon of insulting and belittling religious sanctities, especially Muslim sanctities and symbols, has spread. Various forms of religious intolerance, Islamophobia, and the mockery of beliefs have grown into grave violations of human rights and fundamental freedoms as well as serious threats to international peace and security. Against this backdrop, this research spotlights the issue of defining boundaries between freedom of opinion and expression and the abstention from offending the sanctities, and how this issue has been dealt with in international law. To achieve this objective, this research entails an overview of the various manifestations of the violation of religious sanctities, their repercussions, and an account of the international efforts to strike the right balance between protecting religious sanctities and guaranteeing freedoms. This study reached several findings and recommendations, including calling on international organizations to activate the charters and laws that clearly define the boundaries between freedom of opinion and expression, and the acts resulting from the abuse of this freedom that offend religious sanctities. | ||
