| 520 | |a دراسة هذا البحث دراسة فقهية مقارنة في ولاية التنفيذ القضائي، هدفت إلى بيان ولاية التنفيذ من خلال تعريفها، وتوضيح أبرز المسائل المتعلقة بها؛ وذلك بتتبع نصوص الكتاب والسنة وأقوال العلماء وأهل الاختصاص في الفقه والقضاء، وقد اعتمدت فيها المنهج الوصفي التحليلي والاستقرائي. وخلصت الدراسة إلى أن ولاية التنفيذ حق لولي الأمر، لا يتعداه إلى غيره، وله أن يوكل ويفوض من يشاء لهذه الولاية، ولكن لابد أن يهتم بأمر ولاية التنفيذ القضائي بشدة مع حسن اختيار من يفوض إليهم هذه الولاية الحساسة حيث أنها المرحلة الأخيرة والأهم في انقضاء الدعوى وانتهائها. |b This research is a comparative jurisprudential study in the jurisdiction of judicial execution. It aims to clarify the jurisdiction of execution by defining it, and clarifying the most prominent issues related to it, by following the texts of the Book and the Sunnah and the sayings of scholars and specialists in jurisprudence and judiciary. In it, the descriptive, analytical and inductive approach was adopted. The study concluded that the mandate of execution is the right of the guardian, who does not transgress it to others, and he may delegate and delegate whoever he wants to this mandate, but he must take great care of the matter of the judicial execution mandate with good selection of whom he delegates to this sensitive mandate, as it is the last and most important stage in the expiration of the case And it's over. | ||
