| المستخلص: | تهدف هذه الدراسة إلى تسليط الضوء على الصياغة القانونية وأهميتها في ترجمة نصوص القانون، حيث أن المترجم، وبحكم تكوينه الترجمي، قد يتجاهل بعض أصول الصياغة القانونية أثناء عملية الترجمة، مما يؤدي إلى ترجمة سطحية وغامضة في بعض الأحيان، فترجمة نصوص القانون ترتبط بكلا من الجانبين اللغوي والقانوني، بحكم الطابع المزدوج للترجمة القانونية، مما يستدعي من المترجم تحكما في اللغتين المنقولة والمنقول إليها، إضافة إلى الإلمام بالمعارف القانونية والإحاطة ببعض مباحث علم القانون، كالصياغة القانونية التي تساعدنا في تحرير نص مترجم واضح ومفهوم. The present study deals with legal drafting and its importance in translating the texts of law, as the translator may ignore some legal drafting rules when he translates this kind of texts, which can lead to a superficial and ambiguous translation, at times. In this context, we mention that the dual character of legal translation, related to both linguistic and legal aspects, requires the perfect command of source and target languages, as well as knowledge about the basic principles of law such as legal drafting, which helps us to produce a clear text in the target language. La présente étude vise à mettre en exergue l’importance de la rédaction juridique dans la traduction des textes du droit, vu que le traducteur néglige parfois les règles de la rédaction juridique, lorsqu’il traduit les dits textes, et produit ainsi une traduction superficielle et ambigüe. Dans ce contexte, la traduction des textes juridiques est relative aux aspects linguistique et juridique, d’où la nécessité de maîtriser parfaitement les langues source et cible, acquérir des connaissances inhérentes dans le domaine du droit et apprendre les règles de la rédaction juridique qui nous aident à traduire le texte clairement. |
