| 520 | |a لقد اهتمت هذه الورقة البحثية بصيغة المشاركة المتناقصة المنتهية بالتمليك باعتبارها عقدا من العقود المستجدة على الساحة الفقهية الإسلامية، وهي أحد الأساليب الاستثمارية المستحدثة من طرف المؤسسات المصرفية الإسلامية، والتي بإمكانها المساهمة في تمويل واستثمار وتنمية الأملاك الوقفية، ونلمس في هذا البحث التعرف على حقيقة المشاركة المتناقصة، وضوابطها وحكمها الشرعي، ومدى إمكانية تطبيقها لتنمية الأوقاف الجزائرية على اعتبار أن الجزائر تمتلك حظيرة معتبرة من الأملاك الوقفية غير أن أغلبها غير مستغل بالطريقة الصحيحة، الأمر الذي يحول دون تأديتها للدور الاقتصادي المنوط بها. |b This research paper focuses on the formula of decreased participation leading to ownership as one of the emerging contracts in Islamic jurisprudence, which is one of the investment methods developed by Islamic banking institutions that can contribute to the financing, investment and development of waqf-based properties. In this research, we identify the reality of decreasing participation, its rules and legal ruling, and the possibility of applying them to the development of the Algerian Awqaf on the grounds that Algeria possesses a significant number of Waqf properties, but most of them are not exploited in the right way, which prevents them from playing their full economic role. |d Ce document de recherche s'intéresse à la formule de participation décroissante dans la jurisprudence islamique, qui est l'une des méthodes d'investissement développées par les institutions bancaires islamiques, qui peut contribuer au financement, à l'investissement et au développement de biens immobiliers à base de waqf. Il aborde aussi ses règles et sa jurisprudence, ainsi que la possibilité de les appliquer au développement des Awqaf algériens au motif que l’Algérie possède un nombre important de biens Waqf, mais la plupart d’entre eux ne sont pas exploités correctement, ce qui les empêche de jouer pleinement leur role économique. | ||
