| 520 | |a جاءت هذه الدراسة بهدف إبراز أهمية النص النازلي وحمولته المعرفية في إثراء الواقع التاريخي، وفعالياته الاقتصادية والاجتماعية. وتؤرخ هذه الفتاوى للإطار التاريخي- الزمني– والمكاني، الذي يغطيه كتاب المعيار كموسوعة جامعة لفتاوى بلاد المغرب الإسلامي عامة. حاولت من خلال هذه الدراسة رصد أهم النوازل التي تعرضت لظاهرة الغصب؛ والتي تشكل انعكاسا لجملة ظروف عرفها المغرب الإسلامي بصفة عامة، والمغرب الأوسط بصفة خاصة. فعلى اعتبار ظاهرة الغصب ظاهرة وليدة ظروف سياسية وطبيعية، فإن لها مخلفات اقتصادية، عرقلت سيرورة بعض الأنشطة الاقتصادية. وشكلت وضعا استثنائيا تزامن وبعض المتغيرات الوافدة إلى المغرب الأوسط، وجملة هذه العوامل كان لها تأثيرا بارزا على الحركية الاقتصادية، بل تجاوزها ليمس جوانب اجتماعية وسياسية. جدير بالذكر أن النوازل المتعلقة بظاهرة الغصب واللصوصية، جاءت متواترة، وهو ما يعكس عمق الظاهرة وتأثيرها على الصعيدين الاقتصادي والاجتماعي. هذا فيما تعلق بالكم، أما فحواها فكان شاملا لمختلف المواضيع. إن الاستناد إلى النوازل الفقهية من شأنه إماطة اللثام عن كثير من القضايا التاريخية ذات الأبعاد الاقتصادية. |b إن الاستناد إلى النوازل الفقهية من شأنه إماطة اللثام عن كثير من القضايا التاريخية ذات الأبعاد الاقتصادية. This study came with the aim of highlighting the importance of the descending text and its cognitive load in enriching the historical reality, and its economic and social activities. These fatwas date to the historical - temporal - and spatial framework, which is covered by the book Al-Mayyar as a comprehensive encyclopedia of fatwas in the countries of the Islamic Maghreb in general. Through this study, I tried to monitor the most important cataclysms that were exposed to the phenomenon of usurpation; Which is a reflection of a set of circumstances known to the Islamic Maghreb in general, and the Middle Maghreb in particular. Considering the phenomenon of usurpation is a phenomenon resulting from political and natural conditions, it has economic remnants that hindered the process of some economic activities. It constituted an exceptional situation that coincided with some of the variables coming to the Central Maghreb, and a number of these factors had a prominent impact on the economic dynamics, and even exceeded them to touch social and political aspects. It is worth noting that the calamities related to the phenomenon of usurpation and banditry have been frequent, which reflects the depth of the phenomenon and its impact on the economic and social levels. This is with regard to quantity, but its content was comprehensive of various topics. Relying on the jurisprudential nozal would reveal many historical issues with economic dimensions. | ||
