| 520 | |a إن ما تحمله قرارات المحكمة الاتحادية العليا العراقية من أهداف ومبادئ لا يمكن أن تتحقق ما لم تنفذ تلك القرارات فلا فائدة من إصدارها ما لم يتم تنفيذها إذ يساهم التنفيذ في حماية المبادئ الدستورية التي تضمنتها هذه القرارات ولأهمية التنفيذ تتفق الأنظمة الدستورية بأن ما يصدر عن القضاء الدستوري من قرارات فهي ملزمة للسلطات العامة في الدولة والكافة سواء أكانوا أشخاصا طبيعية أو معنوية فكل ما كانت تلك القرارات محترمة من قبل وجهت لهم كلما كانت العلاقات بين السلطات أوثق وأمتن فلا يخفي على أحد ما يسببه التهرب من تنفيذ قرارات القضاء الدستوري مشاكل تهدد استقرار الأوضاع القانونية وتهدد المبادئ الدستورية التي نصت وأكدت على مبدأ الفصل بين السلطات وحددت اختصاصات كل سلطة ومنها اختصاص السلطة القضاء الدستوري منها فلا يمكن التغاضي عن تلك النصوص وإهدار ما يصدر عن القضاء الدستوري. |b The objectives and principles of the decisions of the Iraqi Federal Supreme Court cannot be achieved unless those decisions are implemented, so there is no benefit in issuing them unless they are implemented, as implementation contributes to protecting the constitutional principles included in these decisions and the importance of implementation.
