| المستخلص: | تأتي الدبلوماسية القضائية المغربية كنتاج للممارسة الدبلوماسية الموازية، وإحدى السبل المثلى من أجل تحقيق الدعم للقضايا الوطنية، لذلك سعت المملكة المغربية إلى تدشين هذا الورش الكبير عن طريق ميكانيزمات تشريعية ومؤسساتية ترنو إلى الدفع بها وتطويرها في أفق جعلها رائدة على المستوى الدولي. ولعل الأبعاد الوظيفية لهذا النوع الجديد من الدبلوماسية، يستقي ماهيته من بعد الدفاع عن الوحدة الترابية، إضافة إلى البعد التعريفي بالتراث القضائي تم البعد الاستثماري والاقتصادي إن تجليات الدبلوماسية القضائية المغربية ضاربة في عمق التاريخ، بدأت بترسيخ المكون العبري المعتبر مادة فريدة ومتميزة في التشريع المغربي، مرورا بالتشريعات الجديدة الرامية لاستقلالية السلطة القضائية، تم المؤسسات الدستورية المنافحة (المجلس الأعلى للسلطة القضائية)، فالاتفاقيات الدولية المبرمة مع المجالس العليا للقضاء الأجنبية. ومن تم فإن التأسيس لدبلوماسية قضائية مغربية لابد لها من مراكمة المكتسبات الحالية والبحث عن قنوات أخرى من أجل تعزيز حظوتها وهو ما سيتأتى من خلال توسيع الشركاء الاستراتيجيين، خاصة الدول الخليجية والآسيوية، إضافة إلى تخصيص أروقة داخل المجلس الأعلى للسلطة القضائية للتعريف بالتراث القضائي العريق. Moroccan judicial diplomacy comes as a product of parallel diplomatic practice, and one of the best ways to achieve support for national issues. Therefore, the Kingdom of Morocco sought to inaugurate this great workshop through legislative and institutional mechanisms that aspire to advance and develop on the horizon to make it a pioneer at the international level. Perhaps the functional dimensions of this new type of diplomacy, its essence, derives from the dimension of defending the territorial integrity, in addition to the introductory dimension of the judicial heritage, the investment and economic dimension. The manifestations of Moroccan judicial diplomacy are deeply rooted in history, beginning with the consolidation of the Hebrew component, which is considered a unique and distinct substance in Moroccan legislation, passing through new legislation aiming at the independence of the judiciary, and the competing constitutional institutions (the Supreme Council of the Judicial Power), and international agreements concluded with foreign supreme judicial councils. Thus, the establishment of a Moroccan judicial diplomacy must accumulate current gains and search for other channels in order to enhance its fortunes, which will come through the expansion of strategic partners, especially the Gulf and Asian countries, in addition to allocating corridors within the Supreme Council of the Judiciary to introduce the ancient judicial heritage. |
