| المستخلص: | مما لا شك فيه تعتبر الطبقة العاملة المحور الرئيسي للنهوض بالحياة الاقتصادية والاجتماعية داخل المقاولات والمساهمة في تنميتها وتطورها وتحقيق رهان استمرارها على المستوى الداخلي والخارجي. لذلك تم وضع جملة من النصوص القانونية الهدف منها إقرار الحماية الاجتماعية للأجير في مختلف تجلياتها وصورها. وبهدف تجسيد هذه الحماية عمد المشرع المغربي على غرار ما تم النص عليه في المواثيق الدولية التي صادق عليها المغرب إلى خلق وإحداث جهاز تفتيش الشغل الهدف منه مراقبة مدى تطبيق القواعد القانونية المتعلقة بالحماية الاجتماعية للأجير. غير أنه بالرغم من ذلك فإن الواقع يؤكد وجود إشكالات وصعوبات حقيقية تحول دون تحقيق الحماية الاجتماعية للأجير. فهذه كلها أمور أثارت فضولنا للبحث في الموضوع وكتابة هذا المقال. Therefore, a number of legal texts were drawn up aimed at establishing social protection for the wage earner in its various manifestations and forms. With the aim of embodying this protection, the Moroccan legislator, as stipulated in the international covenants ratified by Morocco, created and created a labor inspection body whose objective is to monitor the extent to which the legal rules relating to the social protection of the employee are applied. However, despite this, the reality confirms the existence of real problems and difficulties that prevent the achievement of social protection for the wage earner. These are all things that sparked our curiosity to research the topic and write this article. |
