| المستخلص: | نص المشرعون السوري والمصري والفرنسي على ظروف مادية عديدة تشدد العقاب في جرائم الاعتداء على السلامة الجسدية، ويكون السبب ماديا إذا تعلق بالجريمة، وهذه الظروف على تعددها ترد إلى فئتين: فئة يقوم التشديد فيها على كيفية تنفيذ الجريمة. وفئة ثانية يقوم التشديد فيها على درجة جسامة الأذى الذي نال جسم المجني عليه ويفترض أن الأذى الذي ترتب على الفعل لم يقف عند الأذى البسيط، بل جاوز ذلك إلى المساس الجسيم بسلامة الجسم. وقد أكدت جميع التشريعات الجزائية محل الدراسة على تشديد العقوبة في حال توافر أحد هذه الظروف المشددة وإن كان هناك اختلاف بين هذه التشريعات فيما يتعلق بنسبة التشديد في العقوبة في حال توفر أحد هذه الظروف.
