| 520 | |a مجلس المنافسة سلطة إدارية مستقلة تتمتع بالشخصية المعنوية، مهمته ضبط المنافسة في السوق ومنع الاحتكار، يتدخل بإصدار أوامر وقرارات منها قرارات تنظيمية تهم هياكل السوق، وأخرى عقابية تسلط على مرتكبي الممارسات المقيدة للمنافسة. يطعن في قرارات الهيئات الإدارية أمام القضاء الإداري كأصل عام، أين تخاصم الهيئة بغرض إلغاء قرارها، إلا أن مجلس المنافسة لا يخاصم أمام القضاء الإداري إلا بمناسبة قرار رفض التجميع، أما باقي القرارات الرامية إلى وقف الممارسات المقيدة للمنافسة وتلك الموقعة للعقوبة يطعن فيها أمام الغرفة التجارية لمجلس قضاء الجزائر، وهو درجة ثانية للتقاضي ينظر في استئناف الأحكام القضائية الابتدائية، تنتقل إليه المنازعة والأطراف الذين كانوا ممثلين أمام مجلس المنافسة ليفصل بتأييد أو تعديل أو إلغاء قرار هذا الأخير. المقال يتناول قرارات مجلس المنافسة وإجراءات الطعن فيها ومدى حاجة السوق والمنافسة لازدواجية الإجراءات وازدواجية الحماية ما بين مجلس المنافسة والقضاء. |b The concurrence Council is an independent administrative authority with a legal personality. Its mission is to control concurrence in the market and prevent monopoly. It intervenes by issuing orders and decisions, including regulatory decisions that concern market structures, and other punitive decisions that afflict perpetrators of practices restricting concurrence. He challenges the decisions of the administrative organizations before the administrative judiciary as a general principle, where the authority quarrels for the purpose of canceling its decision, but the concurrence council does not quarrel before the administrative judiciary except on the occasion of the decision to reject the assembly, and the rest of the decisions aimed at stopping practices restricting concurrence and those that are subject to punishment are challenged before the Chamber of Commerce at Algiers Judicial Council, which is a second instance of litigation, considers appeals of preliminary judicial rulings . The article deals with the decisions of the Concurrence Council and the procedures for challenging them and the extent to which the market and concurrence need duplication of procedures and duplication of protection between the Concurrence Council and the judiciary. | ||
