| 520 | |a ينطلق البحث من قضية أساسية تتمحور حول أن الفكر الإنساني نتاج البيئة الاجتماعية وبالتالي فهو يخضع (أي الفكر الإنساني) للتأثيرات التاريخية والسياسية والاقتصادية والدينية، التي يخضع لها أفراد المجتمع الذين شكلوا هذا الفكر في إطار التفاعل مع ذلك الواقع، بما يحمله من قضايا ومشاكل وتحديات وتفرض عليهم الاستجابة لها. وعلى هذا الأساس يقوم البحث على محاولة تحديد طبيعة الدولة المدنية ومتطلبات بنائها، والبحث في جذور الدولة المدنية ومفاهيمها في السياسة والقانون والاجتماع، في محاولة للوصول إلى تأسيس مفهوم جامع مانع للدولة المدنية التي اختلفت التخصصات الإنسانية والاجتماعية في تفسيرها وتحديد أسسها ومتطلبات بنائها، إذ يعد مفهوم الدولة المدنية من أكثر المفاهيم جدلية في مجتمعاتنا العربية المعاصرة، نتيجة التباين في مفهوم الدولة المدنية وطبيعة الإدارات السياسية الحاكمة التي تسعى لتشكيل مفهوم لتلك الدولة ينسجم وتطلعاتها ويضفي عليها الشرعية التي تسهم في تلبية متطلبات البناء والوظيفة للدولة. كما حاول البحث تسليط الضوء على أبرز متطلبات بناء الدولة المدنية، كالديموقراطية، وسيادة القانون، والفصل بين السلطات، ذلك أن تلك المتطلبات تمثل جوهر الدولة المدنية ومن دونها تفقد تلك الدولة روحها وكينونتها، ويضحى المواطن فيها غير قادر عن التعبير عن حريته فيها، والتعبير عن آرائه، وممارسة حرياته وحقوقه الفكرية والثقافية والسياسية والدينية، في ظل إطار مؤسساتي خاضع للقانون. وهنا تتحدد طبيعة الدولة الدستورية المدنية كونها مرتبطة بالمواطن الحر والتي يعبر عنها من خلال الانتخابات والقانون الذي يترجم الإرادة العامة للمواطنين المتساوين في الحقوق والمتمتعين بالواجبات. |b The research stems from a basic issue centered around the fact that human thought is a product of the social environment, and therefore it is subject (i.e. human thought) to the historical, political, economic and religious influences to which the members of society who formed this thought are subjected in the context of interaction with that reality, with the issues, problems and challenges it imposes. They have to respond to it. On this basis, the research is based on an attempt to determine the nature of the civil state and the requirements for its construction, and to research the roots and concepts of the civil state in politics, law and society, in an attempt to reach the establishment of a comprehensive concept of the civil state whose human and social disciplines differed in its interpretation and identification of its foundations and requirements for its construction. The civil state is one of the most controversial concepts in our contemporary Arab societies, as a result of the discrepancy in the concept of the civil state and the nature of the ruling political wills that seek to form a concept of that state that is consistent with its aspirations and gives it legitimacy that contributes to meeting the building and job requirements of the state. The research also tried to shed light on the most prominent requirements for building a civil state, such as democracy, the rule of law, and the separation of powers, because these requirements represent the essence of the civil state and without them this state loses its spirit and entity, and the citizen becomes unable to express his freedom in it, and express his views, and the exercise of his intellectual, cultural, political and religious freedoms and rights, within an institutional framework subject to the law. Here the nature of the civil constitutional state is determined as it is linked to the free citizen, which is expressed through elections and the law that translates the general will of citizens with equal rights and duties. | ||
