| المستخلص: | يشكل حق اللجوء أحد المواضيع الأكثر جدلا على الصعيد الدولي، نتيجة لما شهدت الآونة الأخيرة في غالبية البلدان وجود الكثير من اللاجئين لأغراض متعددة منها سياسية واقتصادية واجتماعية وبأعداد كبيرة، وقد يتعرض هذا اللاجئ أثناء وجوده في الدول المضيفة للضرر عند حصول خطأ من الغير، وقد تحدث هذه الوقائع أثناء تفشي وباء كوفيد فمن أجل حصول هذا اللاجئ على حقه يجب أن تتوفر له ضمانات قانونية تضمن الحصول عليه. وتتمثل هذه الضمانات القانونية بحق التقاضي والذي يعد حق مكفول للاجئين بموجب اتفاقية جنيف عام 1951 هذا من جانب، والتأمين الإلزامي والذي يشكل الضمانة الثانية لحصول اللاجئ على حقه، وإن كانت هذه الضمانات هي التي تضمن الحصول على حقه بالتعويض سواء أكان في الظروف العادية أم أثناء تفشي فيروس كورونا. وعليه فإن البحث في الضمانات القانونية التي تخص اللاجئ في ظل هذه الظروف تعد ضرورة ملحة لما لها من أهمية لكل لاجئ يدعي بحقه في التعويض، فلابد مثلا من طرق ووسائل أخرى أكثر فعالية. فاللاجئ أصبح مواطنا ومن ضمن رعايا الدولة المضيفة فينال حقوقه كما هو حال المواطنين الآخرين. The right to asylum is one of the most controversial issues at the international level, as a result of what has recently witnessed in most countries the presence of many refugees for various purposes, including political, economic and social, and in large numbers, and this refugee may be exposed while he is in the host countries to harm when a mistake occurs from others. These incidents may occur during the outbreak of the Covid epidemic, so in order for this refugee to obtain his right, legal guarantees must be available to him to ensure his obtainment . These legal guarantees are represented by the right to litigation, which is a right guaranteed to refugees under the Geneva Convention of 1951 on the one hand, and compulsory insurance, which constitutes the second guarantee for the refugee to obtain his right, even if these guarantees are what guarantee obtaining his right to compensation, whether in normal circumstances or during an outbreak. Corona Virus. Accordingly, researching the legal guarantees that pertain to the refugee under these circumstances is an urgent necessity because of its importance for every refugee who claims his right to compensation. For example, there must be other, more effective ways and means. The refugee has become a citizen and is among the nationals of the host country, so he obtains his rights, as is the case with other citizens. |
