| المستخلص: | يشهد عالمنا المعاصر حالة من التداخل، والتعارض أحيانا بين حرية التعبير وإبداء الرأي من ناحية، ومتطلبات الأمن الوطني بمفهومه الشامل من ناحية أخرى؛ ففي حين تكفل المواثيق والإعلانات الأممية حق الإنسان في حرية التعبير وإبداء الرأي؛ فإن هذه الحقوق أصبحت الآن وبشكل واسع تستخدم للإضرار بالأمن الوطني للدول بمجالاته المختلفة، وذلك عبر ما أتاحته الإنترنت ووسائل الإعلام الرقمي من مساحات وفضاءات لا متناهية للتعبير وإبداء الرأي، دونما رقابة تذكر؛ سواء بشكل متعمد أم غير متعمد؛ الأمر الذي أحدث، ويحدث أضرارا بالغة بالعديد من الدول سواء المالكة والمتحكمة بهذه الوسائل، أم المستهلكة لها. وفي ظل هذه الظروف فإن الورقة الحالية تهدف إلى التعرف على موقع حرية التعبير عن الرأي من المواثيق والإعلانات الأممية والدولية، والظروف التي منحت فيها هذه الحقوق، وكذلك التعرف على بيئة الإعلام الرقمي، وما تتيحه من فضاءات لهذا النوع من الحرية، وما يترتب على ذلك من إيجابيات، وسلبيات، خصوصا ما يتعلق منها بالأمن الوطني للدول بمفهومه الشامل، بداية من أمن الأفراد وحقهم في الخصوصية، ومرورا بأمن المجتمع ومؤسساته المختلفة، وصولا لأمن واستقرار الدولة ككل. ولتحقيق هذه الأهداف استخدمت الباحثة المنهج الوصفي بمداخله: الوثائقي، والمكتبي، والتحليلي، حيث اعتمدت على الوثائق والمصادر والأبحاث والدراسات العلمية العربية والأجنبية، التي تناولت موضوع الورقة ومتغيراتها. وقد توصلت الباحثة من خلال ذلك إلى مجموعة من الاستنتاجات، من أبرزها: إن المساحات اللامتناهية من حرية التعبير وإبداء الرأي التي توفرها بيئة الإعلام الرقمي، أوجدت العديد من المهددات للأمن الوطني بمفهومه الشامل، التي تشكل بدورها خطرا كبيرا على أمن واستقرار الأفراد والمؤسسات والمجتمعات في مختلف دول العالم، الأمر الذي يدعو وبشدة إلى إعادة النظر في المواثيق والإعلانات الدولية المتعلقة بالحق في حرية التعبير وإبداء الرأي؛ والتي وضعت ووقع عليها في ظروف مغايرة لما عليه عالمنا المعاصر في ظل الثورة الرقمية، والفضاءات السيبرانية المفتوحة، وكذلك الحاجة إلى إعلانات أو اتفاقية أو بروتوكولات دولية تحكم وتنظم وتراقب ممارسة الحق في حرية التعبير وإبداء الرأي في بيئة الإعلام الرقمي؛ بالشكل والكيفية اللتان تضمنان حماية هذا الحق؛ ولكن في إطار من المسؤولية المجتمعية، والحفاظ على أمن واستقرار الدول والمجتمعات. Our contemporary world is witnessing a state of overlap, and sometimes conflict between freedom of expression and opinion on the one hand, and the requirements of national security in its comprehensive concept on the other hand. While UN charters and declarations guarantee the human right to freedom of expression and opinion; These rights are now widely used to harm the national security of countries in its various fields, through the endless spaces and spaces provided by the Internet and digital media for expression and opinion, without any censorship. whether intentionally or unintentionally; This has caused, and is causing severe damage to, many countries, whether they own or control these means, or consume them. In light of these circumstances, the current paper aims to identify the location of freedom of expression in international and international charters and declarations, and the circumstances in which these rights were granted, as well as to identify the digital media environment, and the spaces it provides for this type of freedom, and the consequences of that Pros and cons, especially those related to the national security of countries in its comprehensive sense, starting with the security of individuals and their right to privacy, passing through the security of society and its various institutions, to the security and stability of the state as a whole. To achieve these goals, the researcher used the descriptive approach with its entries: documentary, desktop, and analytical. She relied on Arab and foreign documents, sources, research and scientific studies that dealt with the subject of the paper and its variables. Through this, the researcher reached a set of conclusions, the most important of which are: The endless spaces of freedom of expression and opinion provided by the digital media environment have created many threats to national security in its comprehensive concept, which in turn poses a major threat to the security and stability of individuals, institutions and societies in various regions. Countries of the world, which strongly calls for a review of international conventions and declarations related to the right to freedom of expression and opinion; Which was developed and signed in circumstances different from what our contemporary world is in light of the digital revolution and open cyber spaces, as well as the need for declarations, conventions or international protocols that govern, regulate and monitor the exercise of the right to freedom of expression and opinion in the digital media environment; in the manner and manner that ensure the protection of this right; But within the framework of social responsibility, and to maintain the security and stability of countries and societies. |
