| المستخلص: | الأمومة غريزة إنسانية قوية خلقها الباري عز وجل في نفس المرأة وحرمانها من ثمار هذه الغريزة يشكل عذابا نفسيا قاسيا لها ويوقعها في حرج وضيق شديدين ويلحق بها ألما وضررا. والألم النفسي يكون أحيانا أبلغ من الضرر المادي، بل أشد إيلاما منه من نعم الله على الإنسان أن يمنحه الذرية، ومن نوازل العصر وقضاياه المستجدة في مجال الطب عموما والإنجاب ومعالجة العقم خصوصا واستحداث طرق جديدة في الاستيلاد ومنها طريقة استئجار الأرحام، والتي أصبحت الحل الأمثل للحصول على الأطفال في الغرب وانطلاقا من مبدأ الغاية تبرر الوسيلة. أخذت هذه الطريقة تنتشر واتخذت صور عدة، أن مشكلة البحث تتمثل في تفرعات عديدة أهمها: ١. تحديد مفهوم إجارة الرحم بما يشتمل عليه ذلك من تحديد صور هذا العقد وطبيعته القانونية. ٢. الموقف القانوني والشرعي منه سواء في قوانين الدول الغربية والعربية والإسلامية. ٣. الآثار التي تترتب على ذلك العقد من حقوق والتزامات على الطرفين. ٤. تحديد نسب المولود من جانب الأب أو الأم وهل أمه صاحبة البويضة أم صاحبة الرحم.
