المستخلص:إن من الأمور التي يحصل فيها دائما نزاع وخلاف في عصرنا الحاضر، الأراضي الزراعية، وما يتعلق بها من أحكام، فالأرضي الزراعي لها أشكال ملكية متعددة، فمنها الملك الصرف، ومنها التعاقد الزراعي، وهذا التقاعد ينقسم إلى أقسام عديدة، ومنها الأرض المغصوبة، التي هي ملك الدولة، أو ملك شخص ما، يقوم الفلاح باستصلاحها والبناء فيها، ومنع غيره من التصرف بها، وكم حدثت مشاكل ومنازعات بل وحروب بين المالك الأصلي للأرض، وبين من اغتصب الأرض واستعملها، وتطلب الأمر تدخل الحكومة والقضاء في حل الإشكال، ومن هذا المنطلق، جاء هذا البحث لتسليط الضوء على الأحكام الفقهية الخاصة بالتجاوز على الأراضي الزراعي، حيث قمت بدراستها دراسة فقهية مقارنة، مع إبراز حكم قانون الإصلاح الزراعي في الدولة العراقية، ومن الله التوفيق.

One of the issues in which there is always conflict and disagreement in our present time is agricultural lands, and the related provisions. Agricultural land has many forms of ownership, one of which is the exchange property, and one of them is the agricultural contract, and this retirement is divided into many sections, including the usurped land, which is The property of the state, or the property of a person, the farmer reclaims and builds in it, and prevents others from disposing of it, and how many problems, disputes and even wars have occurred between the original owner of the land, and those who usurped the land and used it, and the matter required the intervention of the government and the judiciary to solve the problem, and from this point of view, This research came to shed light on the jurisprudential provisions related to transgression on agricultural lands, which I studied in a comparative jurisprudential study, highlighting the rule of the agricultural reform law in the Iraqi state, and from God the success.
