| 520 | |a إن القرار الإداري يعد عمل من أعمال الإدارة التي تقوم بها، والتي من شأنها إحداث آثار قانونية على عاتق المخاطبين به، لذا فإن من المفترض أن تتصف جميع القرارات الإدارية الصادرة عن الإدارة بالمشروعية، بعدها تكون صادرة وفق القوانين والأنظمة النافذة في الدولة وليس فيها مخالفة للنصوص التشريعية التي تنظمها. وأن قرار منح القدم هو قرار إداري صادر عن الإدارة في حالة توفر سبب منحه، وفق القوانين المنظمة له ووفق الشروط التي تحددها التشريعات، لذا فإن القدم قد يمنح للموظف بقوة القانون بعد أن الإدارة ملزمة بمنحه للموظف المستحق له، ومنح القدم يمثل حافز للموظف في تطوير أعماله ومهاراته وكذلك السعي للحصول عليه؛ لكونه يؤدي إلى اختزال المدة القانونية اللازمة لحصول الموظف على حقوقه الوظيفية المنصوص عليها في التشريعات النافذة. لذا فإن قرار القدم يرتب الآثار القانونية ومنها اختزال المدة المحددة لاستحقاق الموظف لحقوقه، من خلال حصوله على كتاب شكر وتقدير أو اجتيازه دورة تدريبية أو حصوله على شهادة دراسية، وهذه تعد سبب من أسباب منح القدم والتي في حالة توفر شروطها ترتب آثارها القانونية. |b The administrative decision is one of the actions of the administration that it which would cause legal effects on the shoulders of the, undertakes so it is assumed that all administrative decisions issued by the, addressees after which they are issued according to the, administration are legitimate laws and regulations in force in the country and there is no violation of the texts regulated by the legislature.
