| المستخلص: | تعد مشكلة ارتفاع الأسعار من المشكلات الاقتصادية الخطيرة المعقدة التي تعاني منها جميع دول العالم، وتؤثر على استقرارها وتقدمها؛ لأن هذه المشكلة لا تعود إلى سبب واحد، بل لعدة أسباب تتداخل فيما بينها، وتختلف من حيث الأهمية والتأثير، فالذي جعل هذه المشكلة من المشكلات الاقتصادية الكبرى هو ما يترتب عليها من آثار خطيرة على المستوى الاقتصادي والاجتماعي والسياسي والنفسي. لذلك، كان من الضروري على الدول البحث عن طرق لمواجهة هذه المشكلة، ومن أهم وأنجع الطرق في علاج مشكلة ارتفاع الأسعار، الاعتماد على التكنولوجيا الحديثة في كافة مناحي الحياة، ونظرا للأهمية الكبيرة للتكنولوجيا الحديثة في علاج مشكلة ارتفاع الأسعار وغيرها من المشكلات الاقتصادية، ولما كانت الشريعة الإسلامية قد جاءت لإصلاح أحوال العباد في الدنيا والآخرة؛ فقد حثت الشريعة الإسلامية على ضرورة الأخذ بأساليب التكنولوجيا الحديثة -ما دامت لا تتعارض مع القواعد العامة للشريعة الإسلامية، كما اهتمت بها التشريعات الوطنية اهتماما كبيرا في المؤسسات الحكومية والخاصة. وتكمن أهمية البحث في الوقوف على طرق وإجراءات التكنولوجيا الحديثة في علاج مشكلة ارتفاع الأسعار، وذلك في الفقه الإسلامي وفي التشريعات الوطنية. وقد استخدمت في البحث المنهج التحليلي المقارن والمنهج الاستنباطي. لذلك، فقد جاء هذا البحث بعنوان: "دور التكنولوجيا الحديثة في معالجة ارتفاع الأسعار في الفقه الإسلامي والقانون الوضعي"، وتناولته من خلال مقدمة، وأربعة مباحث، وخاتمة. أما المبحث الأول فقد ذكرت فيه: مفهوم التكنولوجيا الحديثة، مفهوم ارتفاع الأسعار، والآثار السلبية لمشكلة ارتفاع الأسعار، والمبحث الثاني فقد ذكرت فيه: تعريف الإنتاج وأهميته، سياسة توجيه الإنتاج وأثرها في علاج ارتفاع الأسعار في الإسلام، ودور التكنولوجيا الحديثة في زيادة الإنتاج وأثرها في علاج ارتفاع الأسعار في القانون الوضعي، أما المبحث الثالث فقد تناولت فيه: مفهوم ترشيد الاستهلاك ومشروعيته، سياسة ترشيد الاستهلاك ودورها في علاج ارتفاع الأسعار في الفقه الإسلامي، ودور التكنولوجيا الحديثة في ترشيد الاستهلاك ودورها في علاج ارتفاع الأسعار في القانون الوضعي، والمبحث الرابع فقد تناولت فيه: تعريف التجارة الإلكترونية وخصائصها، الضوابط الشرعية في عقود التجارة الإلكترونية ودورها في علاج ارتفاع الأسعار، التجارة الإلكترونية ودورها في علاج ارتفاع الأسعار في القانون الوضعي، ثم اختتمت بحثي بما توصلت إليه من نتائج وتوصيات. The problem of high prices is one of the serious and complex economic problems that affects all countries of the world and affects their stability and progress; Because this problem is not a single cause, but for several reasons that overlap and vary in importance and impact, it is the major economic problems that have serious economic, social, political and psychological implications that make it a problem. Therefore, it was necessary for countries to search for ways to confront this problem. One of the most important and most effective ways to address the problem of rising prices is to rely on modern technology in all aspects of life, and in view of the great importance of modern technology in addressing the problem of rising prices and other economic problems, and the fact that Islamic Sharia law came to reform the conditions of worshipers in this world and in the afterlife; Islamic Sharia urged the adoption of modern technology methods- as long as they do not conflict with the general rules of Islamic Sharia, and national legislation paid great attention to them in government and private institutions. The importance of research lies in finding ways and procedures of modern technology in dealing with the problem of rising prices, in Islamic jurisprudence and in national legislation. The comparative analytical and deductive methods have been used in the research. Therefore, this research was entitled "The role of modern technology in addressing the rise in prices in Islamic jurisprudence and positive law", and I dealt with it through an introduction, four discussions and a conclusion. The first research I mentioned: the concept of modern technology, the concept of high prices, and the negative effects of the problem of high prices. The second research I mentioned: the definition of production and its importance; the policy of directing production and its impact on the treatment of high prices in Islam; the role of modern technology in increasing production and its impact on the treatment of high prices in positive law. The third research paper dealt with the concept of rationalization and legality of consumption, the policy of rationalizing consumption and its role in the treatment of high prices in Islamic jurisprudence; the role of modern technology in rationalizing consumption and its role in the treatment of high prices in positive law. The fourth research paper dealt with the definition of electronic commerce and its characteristics, the legitimate controls in electronic commerce contracts and its role in the treatment of high prices, e-commerce and its role in the treatment of high prices in positive law. |
