| المستخلص: | يهدف البحث إلى رصد العملات المشفرة ومميزاتها وعيوبها ومدى إمكانية دخولها تحت مظلة النقود الإلزامية، ويعتمد البحث في جملته على المنهج الاستقرائي، والتحليلي، والمقارن، وقد قسمته إلى ستة مطالب: المطلب الأول: التعريف بالعملات المشفرة، والفرق بينها وبين العملات الإلكترونية، والثاني: مميزات وعيوب العملات المشفرة، والثالث: الحكم الشرعي للعملات الرقمية المشفرة، والرابع: حكم التعامل بالعملات المشفرة في القانون، والخامس: الموازنة بين الفقه الإسلامي والقانون، والسادس: أثر العملات المشفرة على النظام الاقتصادي. وتتلخص إشكالية البحث في استمالة النقود المشفرة لكثير من رجال الأعمال والمالكين للعملات الصعبة، وما تبع ذلك من آثار سلبية على النقد المحلي والنظام الاقتصادي، ويسعى الباحث لبيان خطورة هذه العملات إن لم تندرج تحت مظلة الإصدار النقدي للدولة. وقد أنزلت الحكم على النازلة وتعرضت لمقارنات المذاهب الفقهية الحديثة وعزوت الآيات إلى سورها مع بيان رقم الآية وبيان كون الشاهد آية أو جزء من آية، وخرجت الأحاديث النبوية تخريجا علميا مع بيان الحكم عليه، وذكر الكتاب والباب ورقم الحديث والمجلد والصفحة. The research aims at monitoring crypto currencies, their features, defects and the extent to which they can be entered under the umbrella of mandatory money. The research is based, as a whole, on the inductive, analytical and comparative approach and has been divided into six demands: the first requirement: the definition of cryptographic currencies, the difference between them and electronic currencies, the second: the advantages and disadvantages of crypto currencies, the third: the legal provision of cryptographic digital currencies, the fourth: the rule of dealing with coded currencies in law, the fifth: balancing Islamic jurisprudence with law, and the sixth requirement: the impact of cryptored currencies on the economic system. The research is problematic because many businessmen and owners of foreign currencies are attracted to the coded money, which has a negative impact on the local currency and the economic system. The researcher seeks to explain the seriousness of these currencies if they do not fall under the umbrella of the monetary issuance of the state. She was subjected to comparisons with modern jurisprudence. She attributed the verses to her wall along with the statement of the verse number and the statement of the witness being a verse or part of a verse. |
