| المستخلص: | Tax law has an ambivalent relationship with the concepts of transparency and secrecy. On the recommendation of international organisations, the Tunisian legislator has been led in recent years to broaden the field of transparency. In an effort to fight effectively against tax evasion and to consolidate the image of a cooperative jurisdiction, it has multiplied the obligations of transparency weighing on both the Tunisian State and on taxpayers. Nevertheless, secrecy has kept a reduced place in tax law. The stakes related to the security of economic transactions and the attractiveness of investment impose it. However, marked by its imbalance, the relationship between transparency and secrecy deserves to be reviewed in order to ensure better cohabitation between its partners. Le droit fiscal entretient des rapports ambivalents avec les notions de transparence et de secret. Sur recommandation des instances internationales, le législateur tunisien a été amené, ces dernières années, à élargir le domaine de la transparence. Dans un souci de lutter efficacement contre la fraude et l’évasion fiscales et de consolider l’image d’une juridiction coopérative, il a multiplié les obligations de transparence pesant à la fois sur l’Etat et sur les contribuables. Pour autant, le secret a gardé une place, quoique réduite, en droit fiscal. Les enjeux liés à la sécurité des transactions économiques et à l’attractivité de l’investissement l’imposent. Toutefois, marqué par son déséquilibre, le rapport entre transparence et secret mérite d’être revu en vue d’assurer une meilleure cohabitation entre ses partenaires. |
