| المستخلص: | تباينت التوظيفات المقاصدية للفقهاء المعاصرين في الاستدلال لنازلة إغلاق المساجد احترازا من الإصابة بالوباء، وشكل ذلك جدلا كبيرا بينهم، مما اقتضى تتبع هذا الجدل لمعرفة أسبابه، ومؤيدات كل قول، وهذا ما خصصنا له بحثنا الموسوم بــــ: "إغلاق المساجد بسبب الوباء -دراسة جدلية مقاصدية-". اعتمدنا المنهج التحليلي النقدي الذي اقتضته طبيعة المسألة، مع الاستفادة من المنهج الاستقرائي في تتبع أقوال المعاصرين، وقد خلص البحث إلى أن الجدل الواقع في النازلة يرجع إلى التعارض الواقع بين كلية حفظ الدين وكلية حفظ النفس، وإلى الموازنة بين الضرر الذي يلحقه الوباء بالأنفس وضرر تعطيل صلاتي الجمعة والجماعة، وأن علماء كل قول قد سعوا جاهدين إلى الحفاظ على كليات الشريعة وإلى تحصيل أكثر المصالح ودفع أكثر المفاسد. The use of Maqasid by contemporaries differed in citing the issue of closing mosques due to the pandemic. This formed a great controversy between them, which required tracking this controversy to find out its reasons, and the supporters of each saying. Hence, this is the subject of our research entitled: "Closing mosques due to the pandemic-a controversial Maqasiddia study-". The research adopted a critical analytical method, taking advantage of the inductive method in tracing the sayings of contemporaries. The research concluded that the disagreement in the matter is due to the conflict between the faculty of religious conservatism and the faculty of self-preservation, and to the balance between the harm caused by the pandemic on the psyche and the damage of closing mosques, and that the scholars of each saying sought to preserve the Sharia faculties, collect the greatest amount of interests and pay the greatest amount of corruption. |
