| المستخلص: | خلصنا من هذه الدراسة إلى أن التعذيب فعل مجرم تجريماً مطلقاً في جميع المواثيق والقوانين الدولية، ورغم الحظر المطلق لهذه الجريمة غير أنه لازال يمارس بطرق أكثر وحشية وعنفاً، خاصة وأننا نعيش صراعات سياسية معقدة تمارس فيها مختلف أنواع التعذيب بحجة الحصول على اعترافات أو معلومات من الضحايا، ولم يستطع المجتمع الدولي رغم حرصه على سلامة الإنسان القضاء على هذه الجريمة التي وإن اختلفت أساليبها وأنواعها غير أن تأثيرها ونتائجها واحدة، وعلى ضوء ذلك فلقد جاءت النصوص الدولية لحماية الإنسان من التعرض لكافة أشكال التعذيب أو الممارسات القاسية من خلال تجريم هذا السلوك وتحميل المسؤولية الجنائية للمجرمين وكذلك تكييف التعذيب كجريمة حرب وجريمة ضد الإنسانية وجريمة إبادة جماعية قائمة بذاتها، لها أركانها المادية والمعنوية سعياً منه إلى تشديد العقاب وتأكيد الحظر المطلق لهذه الجريمة التي تهدد حياة الأفراد واستقرار الدول. We have concluded from this study that torture is an absolute criminal act in all international conventions and laws. Despite the absolute ban of this crime, it is still practiced in more brutal and violent ways. Especially since we live in complex political conflicts in which various types of torture are practiced under the pretext of obtaining confessions or information from victims. The international community, while concerned about human safety, has not been able to eradicate this crime, whose methods and types may differ, but its impact and consequences are the same. Therefore, international texts have come to protect human beings from exposure to all forms of torture or cruel practices; by criminalizing this behavior and holding the criminals responsible, as well as considering torture as a war crime, a crime against humanity, and a crime of genocide in its own right; having its material and moral elements. It seeks to tighten punishment and confirm the absolute ban of this crime that threatens the lives of individuals and the stability of states. |
