| 520 | |a شرعت فرنسا الزواج المدني، ثم اكتسبت شرعيته من الإعلان العالمي لحقوق الإنسان في المادة 16 ومفادها إيجاز الزواج المدني دون أي قيد بسبب العرق أو الجنسية أو الدين، وفي مصر يطبق في الشهر العقاري بوزارة العدل على غرار الزواج المختلط ويكون بين مسيحي ومسلمة، أو مسلم ومسيحية؛ مما ينتج عنه مخاطر للأمن المجتمعي والعقائد الدينية والحقوق، ويهدف البحث معرفة أبعاد الزواج المدني اجتماعيا وقانونيا من خلال دراسة استطلاعية تتبنى نظرية المجال العام عبر وسائل التواصل الاجتماعي، وتعمد لدراسة حالات مثيرة للاستبصار. وقد توصل إلى نتائج أهمها للبعد الاجتماعي أن وعي الأسرة من المحاور التي أثرت في الإقبال، كما تبين تأثير جماعة الأقران والأقارب على الدعم والتحفيز، مما انعكس على طبيعة التعايش مع المحيط المجتمعي للحالات التي استقرت في مصر بشكل دائم. وعلى طبيعة التجانس والتوافق بين الزوجين من حيث الشعور بالرضا والمسؤولية. كما أثرت وسائل التواصل الاجتماعي على تنامي الظاهرة من خلال سرعة التعارف والحوار وتقليص المسافات بين الأفراد، لثقافة النسق العالمي التي تتيح التواصل بحرية دون قيود الدول والأديان والأجناس واللغات. أما قانونيا مازال الزواج المدني في مصر في أضيق الحدود، لعدم وجود قانون يعترف بالزواج المدني إلا أن الحالات الموجودة تم إبرام عقدها خارج مصر أو بشكل غير رسمي أو على غرار زواج من أجانب. كما أن الحقوق المدنية التي يكفلها الزواج المدني للمرأة لا تناسب الضوابط الدينية والتشريعية، بل تتعارض مع الحقوق والواجبات والممنوعات والمسموحات في الزواج الإسلامي والمسيحي. |b France legalized civil marriage, then gained legitimacy from the Universal Declaration of Human Rights in Article 16, which states that civil marriage is permitted without any restriction because of race, nationality or religion. And on the nature of homogeneity and compatibility between spouses in terms of a sense of satisfaction and responsibility. Social media has also affected the growth of the phenomenon through the speed of acquaintance and dialogue and the reduction of distances between individuals, due to the culture of the global format that allows communication freely without restrictions of countries, religions, races and languages. As for legally, civil marriage in Egypt is still within the narrowest limits, There is no law recognizing civil marriage, but the existing cases were concluded outside Egypt, informally, or similar to marriage with foreigners. Moreover, the civil rights guaranteed by civil marriage to women are not compatible with religious and legislative controls, but rather conflict with the rights in Islamic and Christian marriages. | ||
