| المستخلص: | يمثل الاجتهاد بالرأي في النصوص سبيلا للإيفاء بحاجات الناس والإجابة عما يعترضهم من أحوال ووقائع ومستجدات من خلال إعمال النصوص واستثمار جميع مكوناتها وطاقاتها ودلالتها واستجلاء روح التشريع، وقد تناولت هذه الدراسة حقيقة الاجتهاد بالرأي في النصوص وأهميته، كما بينت أنواع النصوص بالنسبة لخضوعها للاجتهاد بالرأي من عدمه، والضوابط اللازمة في عملية الاجتهاد بالرأي في النصوص وكيفية توظيفه في عملية استنباط الأحكام الشرعية في المسائل المعاصرة ومنها ما نحن بصدده. وأكدت الدراسة أن من ضروب الاجتهاد بالرأي في النصوص القطعية الاجتهاد في التطبيق والتنزيل والفهم، وأن الأخذ بمذهب من يقول بعدم ثبوت خيار المجلس وتفسير (التفرق) بالأقوال لا بالأبدان فيه دلالة على مرونة الفقه الإسلامي ومقدرته على مواكبة تطورات العصور والأزمان مع الأخذ بضرورة العلم بالقبول بالنسبة للموجب في التعاقد بين غائبين بسبب تقدم وسائل الاتصال الحديثة وتعقد المعاملات، وتحقيقا لاستقرار التعامل. Ijtihad opinion in the texts represent a way to meet people's needs and what they can face, conditions, events, and updates throw the proper use of the texts and exploit all of the text hidden meaning and its energy, indications and explain the Islamic legislation spirit. This research showed the truth and the importance of the Judgment in texte. and it showed the types of the texte whether if it is submitted to the Judgment or not, and the necessary standards in the operation of the Judgment in texte, and howwe canexploite the Judgment of the texte in deriving of the provisions of Islamic law in conemporary issues, one of them is what we are talk about:- trading by electronic contracts. This research has emphasized that Judgment in the certain texte should be in the imphasized and understanding, we should take the provision which says that the buyer and the seller can accomplish the deal or cancel it by talking to each other not by meeting each other physically. To indicate the Islamic doctrine and its ability to keep up with the evolution of the ages and times, and give consideration to the necessity of the knowledge acceptance of the acceptor in the compact between the absent because of the advancement of the modern communications media and the complexity of the transaction to reach to the treatment balance. |
