| المستخلص: | يعتبر موضوع آثار شغور العضوية النيابية من أهم المواضيع التي اهتم الفقه الدستوري بها، ولا شك أن حالات شغور العضوية النيابية تؤثر على المجلس من حيث خلو المقعد النيابي، بالإضافة إلى بحث مدى تأثيرها على الأعمال النيابية وعلى حقوق النائب. لذلك جاءت مشكلة هذا البحث تدور حول بيان الآثار القانونية التي تترتب على انتهاء عضوية النائب من خلال شغور العضوية النيابية؛ فتم بحث آثار شغور العضوية النيابية على حقوق النائب والأعمال النيابية، ومن ثم بحث آلية ملء المقعد الشاغر الناتج عن شغور العضوية. وخلصنا في نهاية البحث أنه من الأولى أن ينص المشرع الأردني على حالة انتهاء العضوية النيابية للمستجوب، وأن يرد نص باستمرار الاستجواب في حالة انتهاء العضوية النيابية أو على الأقل استمراره في حالة تبنيه من قبل نائب آخر. The issue of the effects of a parliamentary vacancy is one of the most important issues that constitutional jurisprudence is concerned with, and there is no doubt that cases of parliamentary vacancy affect the parliament in terms of the vacancy of the parliamentary seat, in addition to examining the extent of their impact on parliamentary work and the rights of the representative. Therefore, the problem of this research revolves around the statement of the legal consequences of the termination of the membership of the representative through the vacancy of the parliamentary membership; The effects of the parliamentary vacancy on the rights of the representative and parliamentary work were examined, and then the mechanism for filling the vacancy resulting from the vacancy of membership was discussed. And we concluded at the end of the research that it is better for the Jordanian legislator to stipulate the termination of the parliamentary membership of the questioned, and to provide a text for the continuation of the interrogation in the event of the termination of the parliamentary membership, or at least its continuation in the event of adoption by another deputy. |
