| 520 | |a بهدف تنظيم الرقابة القضائية على أعمال الإدارة، فقد اتجهت الدول إلى اتجاهين إثنين، دول سارت لتأخذ بالقضاء الموحد، وأخرى لتأخذ بالقضاء المزدوج، فحددت ولاية واختصاص كل محكمة حسب نظام القضاء المتبع،. إذ يعد الاختصاص معيارا للسلطة التي خولها القانون لمحكمة ما، وفي نوع معين من الدعاوى، وفي حدود معينة أوجب عليها عدم تجاوزها، وإلا عد الحكم القضائي الصادر عنها باطلا لمخالفته لأحكام القانون، وبناء على هذا، فإن اختصاصات جهات القضاء الإداري في الدول المقارنة كلا من فرنسا ومصر ليست مطلقة، بل مقيدة وترد عليها استثناءات عديدة، كما إن الاستثناءات التي تخرج عن اختصاصات القضاء الإداري بالعراق مازالت تدخل في قوسها عدد كبير من القرارات والأوامر الإدارية التي حدد المشرع مرجعا خاصا للتظلم منها أو الاعتراض عليها أو الطعن فيها وتغبن فئات من الأشخاص والموظفين وتحرمهم من حق التقاضي والطعن بالقرارات والأوامر الإدارية الصادرة بحقهم من جهة الإدارة، وفي هذا تناقض مع مبدأ العدالة ومبدأ حق التقاضي ويشكل مخالفة دستورية وقانونية واضحة. |b With the aim of organizing judicial oversight on the work of the administration.
