| 520 | |a إن البحث في المحكمة الدستورية لإقليم كوردستان في ظل مشروع دستور إقليم كوردستان- العراق لعام (2009) يعد في غاية الأهمية، وذلك للتأكد على أن المحكمة الدستورية لها دور قانوني فعال لحماية الدستور من العبث والحفاظ على حقوق الأفراد وحرياتهم، ومما لا شك فيه ان النصوص الدستورية ومبادئها العامة التي تنظم السلطات العامة وعلاقتها بحقوق وحريات الأفراد لا تجدي نفعا إذا لم تصونها المحكمة الدستورية من الانتهاكات؛ ولذلك في بحثنا هذا قمنا بتوضيح تشكيل المحكمة الدستورية وبيان طبيعة أحكامها من ناحية، ومن ناحية أخرى تناولت اختصاصات المحكمة الدستورية وفق مشروع دستور إقليم كوردستان- العراق، وثم أوضحت في البحث كيفية رفع دعوى دستورية أمام المحكمة الدستورية، وناقشت الطرق الجديدة التي اتخذت بها المشرع الدستوري في مشروع الدستور ومقارنتها بأنظمة القانونية المقارنة، وأخيرا اختتمت البحث بجملة من النتائج والتوصيات. |b It is of academic significance to conduct researches on the constitutional court of Kurdistan Region-Iraq in light of the draft constitution of the Kurdistan region- Iraq for the year 2009. It sheds lights on the importance of the effectiveness of it legal functions and roles of the constitutional court to preserve the constitution from crisis and to protect individuals’ rights of freedoms. There is no doubts that the constitution and its principles regulates the public authorities and their relationship with the individual freedoms as the individual freedom will not in practice if it is not protected by constitutional laws. Therefore, the current paper firstly displays the formation of the constitutional court and the nature of its laws and codes. It then dealt with the competencies of the constitutional court in accordance with the draft constitution of the Kurdistan Region - Iraq. It also demonstrates the steps to file a constitutional case before the constitutional court. The study further discusses a novel method in which constitutional legislators follow to form constitution and compare it with other legal forms. Finally, the paper gives a number of conclusions and recommendations. | ||
