| المستخلص: | إن حماية وعاملة الأسرى أصبحت من المسائل المهمة في كل الدول، كما إن حمايتهم قد أصبحت لا تقتصر على مناطق بعينها، بل تمتد إلى مناطق أخرى. وأصبح الإنسان في كل مكان من العالم يشكو من سوء المعاملة. وقد تزايدت هذه الظاهرة الخطرة، وأصبحت هذه المشكلات إحدى القضايا البارزة على المستوى السياسي والقانوني، متقدمة على غيرها من القضايا، وقد جاء الإدراك الواسع لمخاطرها وما تمثله من تحد واسع لبقاء الإنسان ورفاهيته من جهة، والارتباط الوثيق بين مشاكلهم والأنظمة الاقتصادية والسياسة والتكنولوجية من جهة أخرى. بالإضافة إلى أن الحروب التي عاصرت المجتمعات البشـرية منذ نشأتها، وقاست ويلاتها على مر العصور، وأسفرت بالتالي عن وقوع أضرار كبيرة ضدهم. وفي وقتنا الحالي ازداد وبشكل ملحوظ وقوع العديد من النزاعات المسلحة، سواء كانت دولية بين دولتين أو أكثر أو منازعات غير دولية. وأصبحت هذه المنازعات أكثر ضررا للأسرى. كما أنه لا يمكن لأي مجتمع متحضر أن يتغاضى عن الجرائم التي أصبحت تشكل تهديا للأمن والسلم الدوليين لخطورتها وما ينتج عنها من آثار وأضرار جسيمة، وما يتعرض له بلدي العراق وعدد من الدول إلى انتهاكات جسيمة للأسرى في النزاعات المسلحة. ومع تنامي الوعي لدى أفراد المجتمع الدولي حول حقيقة معاملة أسرى الحرب وشموليتها وتوسيع نطاق ضررها، فقد أبدى المجتمع الدولي بما فيها الدول النامية، المتضررة من هذه الظاهرة، معارضة شديدة ومتصاعدة إزاء سياسة منع العقاب، وتطورت معها الرغبة في محاسبة مرتكبي الجرائم وتحميلهم مسؤولية ما ارتكبوه، ومن ثم العمل على وقف كل أشكال الانتهاكات التي يحتمل أن تضر بالأسرى، ومن خلال ذلك فقد ظهر نظام جديد هو نظام المساءلة عن الجرائم. وعلى الرغم من أن المجتمع الدولي لم يغفل الاهتمام بحمايتهم، إلا إننا ما نشاهده في كثير من الدول من انتهاكات لهم، كما هو الحال في الدول العربية وغيرها من دول العالم لا يقارن انطلاقا من الحماية التي تقدمها الاتفاقيات الدولية المتعددة لهم. The protection and treatment of prisoners has become an important issue in all countries, and their protection has become not limited to specific regions, but extends to other regions. Everywhere in the world people are complaining of abuse. This dangerous phenomenon has increased, and these problems have become one of the prominent issues at the political and legal level, ahead of other issues, and the wide awareness of its dangers and what it poses a broad challenge to human survival and well-being on the one hand, and the close connection between their problems and economic, political and technological systems on the other hand. In addition to the wars that have witnessed human societies since their inception, and their woes have endured throughout the ages, and thus resulted in great damages against them .In our time, the incidence of many armed conflicts, whether international between two or more states or non-international conflicts, has increased significantly. These disputes became more harmful to the prisoners. Nor can any civilized society condone the crimes that have become a threat to international peace and security because of their seriousness and the resulting effects and massive damage, and what my country, Iraq and a number of countries are subjected to, to grave violations of prisoners in armed conflicts .With the growing awareness among members of the international community about the reality of the treatment of prisoners of war and its comprehensiveness and the expansion of its harm, the international community, including the developing countries, affected by this phenomenon, has expressed strong and escalating opposition to the policy of preventing punishment, and with it the desire to hold the perpetrators of crimes accountable and hold them responsible for what they committed has developed., and then work to stop all forms of violations that are likely to harm prisoners, and through this a new system has emerged, which is the system of accountability for crimes. Although the international community has not neglected to protect them, what we see in many countries of violations of them, as is the case in the Arab countries and other countries of the world, is incomparable based on the protection provided by the various international agreements to them. |
