| المستخلص: | يهدف هذا البحث إلى الإجابة على سؤالين، هما: ما هي حقيقة النسخ الضمني؟ وما هو الفرق بين النسخ الضمني والنسخ الصريح؟ وقد تناولت البحث في مقدمة ومبحثين وخاتمة. وقد تناولت في المبحث الأول حقيقة النسخ الضمني مستعرضا تعريفات العلماء للنسخ الضمني ثم ذكرت التعريف المختار، وأجبت عما يمكن الاعتراض به على حقيقة النسخ الضمني وبينت تقسيم النسخ الضمني باعتبار صراحة العلم بالتأخر، وتقسيمه باعتبار ما يقع بينه التعارض. وتناولت في المبحث الثاني أوجه الجمع والفرق بين النسخ الصريح والضمني، أوردت فيه أربعة أوجه للجمع بين النسخ الصريح والضمني، ثم ذكرت أربعة عشر فرقا، ثم بينت أثر إدراك الفرق بين النسخ الصريح والضمني، وجعلته في سبعة فروق. ثم عقدت خاتمة أوردت فيها النتائج والتوصيات. This paper aims to answer two questions: (1) What is the reality of implicit abrogation? (2) What is the difference between implicit and explicit abrogation? The paper consists of an introduction, two sections and a conclusion. In Section One, I dealt with the reality of implicit abrogation, discussing scholars’ definitions, then I mentioned the selected definition and responded to the possible objections about the reality of implicit abrogation. I then discussed the categories of abrogation in terms of overt knowledge of late occurrence. I also discussed its categories in terms of internal controversy. In Section Two, I explored the aspects of reconciliation and differentiation between implicit and explicit abrogation. In this section I mentioned four methods for reconciliation between implicit and explicit abrogation. I then listed fourteen differences between them and showed the overlap of the differences between them that could be summed up in seven points. Finally, in the conclusion I discussed the findings and recommendations. |
