| المستخلص: | أن حقوق الإنسان بصفة عامة وحق الإنسان في بيئة سلمية بصفة خاصة هي مسؤولية الإنسان ذاته وحين تنتهك يكون الإنسان هو الضحية وقد أدى التقدم العلمي الذي سعى الإنسان إلى تحقيق بعض المكاسب منه إلى أن ترتبت عليه في الوقت ذاته أضرار تهدد وجوده على الأرض، وأن موضوع النفط والبيئة يعد من الموضوعات المهمة التي فرضت نفسها وصارت تأخذ الكثير من الاهتمام ليس فقط على المستوى الدولي بل في المؤتمرات العالمية والاتفاقيات، وكذلك إلى قيام بعض الدول بوضع السياسات واتخاذ الإجراءات وإصدار التشريعات، وقد توصلت الدراسة إلى أن من الدوافع التي تشجع على ارتكاب الجرائم البيئية جشع الإنسان واستغلاله البشع للثروة الطبيعية والسباق نحو التقدم بين البلدان واستغلال الدول الغنية للدول، ويعد تلوث الهواء أوسع أشكال التلوث نظرا لسرعة انتقاله ويؤثر تلوث الهواء على صحة الإنسان ويؤدي إلى أصابته بالأمراض مختلفة، ويوصي الباحث إلى ضرورة إنشاء محكمة مختصة بالنظر في الجرائم البيئية وصبغها بالطابع الاستعجالي أو تكوين قضاة للحكم مختصين في الجرائم البيئية على أقل تقدير، وكذلك ضرورة وضع سياسة عامة وشاملة للدولة فعالة للمكافحة والحد من خطر جرائم تلوث البيئة الهوائية بالنفط واثرها على صحة الإنسان. Human rights in general and the human right in a peaceful environment in particular are the responsibility of the human being himself, and when they are violated, the human being is the victim. The environment is one of the important issues that have imposed themselves and are taking a lot of attention, not only at the international level, but also in international conferences and conventions, as well as for some countries to develop policies, take measures and issue legislation, and the study concluded that one of the motives that encourage the commission of environmental crimes is greed. Man and his hideous exploitation of natural wealth and the race towards progress between countries and the exploitation of rich countries by countries. Air pollution is the most widespread form of pollution due to the speed of its transmission. Air pollution affects human health and leads to various diseases. Or the formation of judges to rule specialized in environmental crimes, at the very least, as well as the need to develop an effective general and comprehensive policy for the state to combat and limit Of the danger of crimes that pollute the air environment with oil and their impact on human health. |
