| المستخلص: | أفرزت الوسائل المعلوماتية مشكلات تتعلق بإثبات العقد المبرم بهذه الوسائل المعلوماتية وهذه المشكلات تمثل تحديا للنظم القانونية المعهودة، ومن أبرز هذه المشكلات هو أن التعاقدات المعلوماتية في ظل غياب الدعامات المادية تتم عن طريق وسائل معلوماتية في صورة بيانات مكتوبة أو صوت وصورة تظهر على شاشات الحواسيب الألية أو الأجهزة المحمولة وتستخدم في مسائل تتعلق بنشوء الرابطة الزوجية وانقضاءها. وهنا ينشأ تخوف من احتمال عدم الحصول على دليل مادي يثبت ما تم إبرامه من مسائل تتعلق بالأحوال الشخصية كعقود الزواج المبرمة إلكترونيا، وكذلك إيقاع الطلاق، أو إنشاء الوصية عبر الوسائل الإلكترونية، خصوصا في ظل غياب الوسيط المادي الذي تتم فيه هذه المسائل وحيث تتم بين اطراف لا يجمعهم سوى حضور افتراضي معاصر على الشبكة ولا يملك أي منهم سيطرة على النظام التقني المستخدم أو المعرفة المسبقة بفنياته التقنية مما يترتب عليه ظهور مشكلات قانونية تتمثل التردد في قبول الأدلة المعلوماتية في الإثبات نظرا للتشكيك في قدرتها على أداء الوظائف التي تؤديها وسائل الإثبات التقليدية، لا سيما وان الواقع التقني يشير إلى أن المحترف أو المهني بما يملكه من سيطرة على الأدوات التقنية يكون لديه إمكانية إعداد دليل مسبق على تصرفه ويسيطر على إنشاءه بمفرده مما يشك في حجيتها الكافية.
