| المستخلص: | تتطور المجتمعات وتتطور المشاكل الزوجية، وتستفحل إلى حد يجعل استمرار العلاقة الزوجية مستحيلا، وعندما يلجا أحد الطرفين إلى القضاء بغرض إنهاء الرابطة الزوجية بصفة رسمية، غير أن الزوجة المعوزة وأبنائها في حالة قيام العلاقة الزوجية أو انفصالها لا تنتهي معاناتهما عند هذا الحد بل إنهما غالبا ما يجدان نفسهما في مواجهة مشكلة أخرى تتجلى أساسا في صعوبة تحصيل مبالغ النفقة المحكوم بها على الزوج بسبب عجزه أو تماطله في أداء المستحقات أو حتى تهربه منها في معظم الأحيان. وتعتبر مشكلة تنفيذ الأحكام الصادرة في قضايا النفقة من بين الإشكالات التي تؤرق بال الجميع، إذ أن تعنت المحكوم عليهم من أداء النفقة إما لامتناعهم أو لعوزهم المادي، أفرز ضرورة البحث عن آلية تمكن الزوجة والأطفال من حصولهم على مستحقاتهم خصوصا عندما يكون الزوج معسرا، وهو ما توج بإحداث صندوق التكافل العائلي الذي يعد مشروعا اجتماعيا متميزا.
