| المستخلص: | يدور هذا البحث حول موقف ديفيد ليونز من العنصرية والعبودية في المجتمع الأمريكي موضحا مدى تعارض ذلك مع القانون وحقوق الإنسان، تلك الحقوق التي تثبت كونه إنسانا بصرف النظر عن اللون والجنس والدين، كالمساواة والعدالة والديمقراطية والملكية والحرية والحق في التعليم والعلاج والعمل وحرية الانتقال والإقامة والجنسية واحترام الخصوصية فضلا عن الحق في الزواج وبناء الأسرة؛ فهي حقوق قانونية ومبررة أخلاقيا؛ أي يمكن الدفاع عنها أخلاقيا وبالتالي لا صحة للآراء التي تفصل تلك الحقوق عن الأخلاق، مؤكدا على دور القانون في الحفاظ على تلك الحقوق مع الالتزام بالقانون العادل الذي يحقق وظائفه من جهة الحاكم والمحكوم معا، ويمنح الحق للشعب في العصيان المدني للقانون في حالة غياب العدالة، مناديا بإلغاء العنصرية وعدم التفرقة بين الجنس الأمريكي بسبب اللون والجنس أو الدين، كاشفا عن خلو الإدارة الأمريكية من العدالة في هذا الجانب وإفلاسها الأخلاقي. This research revolves around David Lyons' position on racism and slavery in American society, explaining the extent to which it contradicts the law and human rights, those rights that prove that he is a human being regardless of color, gender and religion, such as equality, justice, democracy, property, freedom, the right to education, treatment, work, freedom of movement, residence, nationality and respect Privacy, as well as the right to marry and build a family, are legal and morally justified rights, that is, they can be defended morally, and therefore there is no validity to the opinions that separate those rights from morals, stressing the role of the law in preserving those rights while adhering to the just law that fulfills its functions on the one hand. The ruler and the ruled together, and grants the people the right to civil disobedience to the law in the absence of justice, calling for the abolition of racism and non-discrimination between the American race because of color, gender or religion, revealing that the American administration is devoid of justice in this aspect and its moral bankruptcy. |
