| المستخلص: | تهدف هذه الدراسة إلى إبراز أهمية القاعدة المقاصدية: "قاعدة اعتبار المآل"؛ حيث تبين أنها أصل من أصول الاجتهاد الفقهي، له أدلته وحجيته، وله فروع تندرج منه وله آثاره. ثم تحاول أن تنقله من النظرية إلى التطبيق في أهم جانب من جوانب الفقه الإسلامي والذي أولاه التشريع الإسلامي عناية خاصة ألا وهو أحكام الأسرة، فاختارت بعض المسائل كالولاية في الزواج ونكاح التحليل، ومنها ما يحدث غالبا عند الأقليات المسلمة في بلاد الغرب كالزواج بنية الطلاق والزواج بالكتابيات. وحاولت الدراسة أن تنزل الأحكام على هذه المسائل وهي تنظر إلى ما ستؤول إليه الأمور في المستقبل من استقرار في الأسرة، ودوام سعادة وحسن معاشرة؛ والتي هي مقاصد شرعية أساسية للزواج الإسلامي ليخرج منه نسل صالح يعبد ربه، ويعز أمته بعد هذا الذل والهوان الذي أصابها بين الأمم، وما ينخر في جسمها من الداخل من تشرذم شبابها، وتفكك أسرها، وانتشار الظواهر السلبية الخطيرة في مجتمعاتها. This study aims to highlight the importance of the intentional rule: “the rule of consideration of Destiny”; As it turned out that it is one of the principles of jurisprudence, has its evidence and authoritative evidence, and has branches that fall from it and has its effects. Then it tries to transfer it from theory to practice in the most important aspect of Islamic jurisprudence, to which Islamic legislation has given special care, which is the jurisprudence of family Worshiping Allah So it chose some issues, such as guardianship in marriage and the marriage of tahleel, including what often happens among Muslim minorities in Western countries, such as marriage with the intention of divorce and marriage with biblical woman. the future of stability in the family, and the continuation of happiness and good cohabitation; Which are the basic legal purposes of Islamic marriage to produce righteous offspring. And he cherish his nation after this humiliation and humiliation that befell it among the nations, and what is eroding its the inside of the fragmentation of its youth, the body from disintegration of its families, and the spread of serious negative phenomena in its societies |
