| المستخلص: | تقوم الدولة بمهامها عن طريق الموظفين العموميون، ونظرا لأهمية دور الموظف العام في هيكلة الدولة يتم وضع أطر تنظيمية لحقوقه وواجباته بما يضمن حسن سير عمل المرفق العام، ويهدف البحث إلى وضع إطار عام لحقوق وواجبات الموظف العام في ظل القواعد القانونية المتطورة التي تناولتها الأنظمة المستحدثة في المملكة العربية السعودية، كما يلقي الضوء على التطور الدائم للنظام السعودي في فكرة الوظيفة العامة بشكل عام والموظف العام بشكل خاص، فيصدر أنظمة جديدة بشكل يتواكب مع التطورات التي تمر بها الوظيفة العامة، كما يهدف البحث إلى تحديد إطار الثوابت والمتغيرات في حقوق وواجبات الموظف العام، ويعتمد البحث على المنهج الوصفي التحليلي، في دراسة حقوق وواجبات الموظف العام في ظل النظام السعودي ولوائحه المستحدثة وذلك لمناسبة هذه المنهجية في تحديد خصائص موضوع البحث بغية كشف ما يمكن تطويره. وقدر درجت الأنظمة السعودية المتتالية على وضع تنظيم لحقوق وواجبات الموظف العام كان من الأحرى أن تجمع في تنظيم واحد، فمن خلال هذا البحث تم عمل دراسة لحقوق وواجبات الموظف العام في النظام السعودي بمختلف مصادر هذه الحقوق، وتحليل التنظيم القانوني لهذه الحقوق بما يتناسب وطبيعة المرحلة التي تمر بها المملكة العربية السعودية، وهي في إطار بناء قاعدة تشريعات مقننة متكاملة لأنظمة المملكة العربية السعودية. The research was conducted according to the descriptive analytical method, to study the rights and duties of the public employee under Saudi law and the new executive regulations, as this methodology is appropriate To determine the characteristics of the research topic in order to know what can be developed Successive Saudi laws establish a regulation of the rights and duties of a public servant. And it would have been better if they were combined in one law, Through this research, an analytical study of the rights and duties of the public servant in Saudi law was made in various sources of these rights and duties, and the legal regulation of them was analyzed in a manner appropriate to the nature of the stage that the Kingdom of Saudi Arabia is going through, to build a comprehensive written legislation base for the laws of the Kingdom of Saudi Arabia. |
