| المستخلص: | حفظ النسل وعلاقته بمقاصد الشريعة هو عنوان البحث الذي نتناوله في هذه الورقات، وهو من الموضوعات التي يحتاج إليها الناس لاسيما في كيفية المحافظة على النسب، فجاءت هذه الدراسية لتبين مفهوم النسب، وعلاقتـه بالمقاصد. لقد اهتمت الشريعة الإسلامية اهتماما كبيرا بالنسل وكيفية المحافظة عليه، واتخذت إجراءات وتدابير من أجل ديمومته واستمراره. وبالنسل تستمر الحياة، وتوقف النسل مؤذن بنهايتها؛ ولذلك شرع الإسلام الزواج ضمانا لامتداد النسل، ورعاية وحفظا له؛ فالزواج يحفظ النسل من جانب البقاء، وحفظ النسل من جانب المنع بتحريم قتل الأولاد. وقد تضمن البحث أهم النتائج التي توصلت إليها، وهي أن الإسلام شرع وسائل متعددة من أجل المحافظة على النسل، وذلك من ناحيتي الوجود والعدم، منها: الترغيب بالزواج، وتحريم الزنا، والقذف، وجعل لهم عقوبات محددة. ولحفظ النسل علاقة في الحاجيات حيث أن الحاجيات مكملة للضروريات وكذلك له علاقة بالتحسينيات من حيث أن التحسينيات هي مكملة للضروريات والحاجيات. وأن اهم نتيجة توصلت إليها في هذا البحث هو وجود علاقة وثيقة بين حفظ النسل ومقاصد الشريعة، فهي مرتبطة بالكتاب والسنة ارتباط الفرع بالأصل لأن أصل استمداد المقاصد من الكتاب والسنة. Islamic law has paid great attention to the offspring and how to preserve it, and has taken measures and measures for its sustainability and continuity. The marriage continues to live, and the offspring stops the muezzin at the end; therefore Islam began marriage to ensure the extension of the offspring, and care and conservation of it; marriage saves the offspring from the side of survival, and keeping the birth by forbidding the killing of children. The research included the most important findings, which is that Islam has embarked on multiple means for the conservation of the offspring, both in terms of existence and non-existence, including: Marriage, and the prohibition of adultery, slander, and make them specific penalties. The conservation of offspring is related to the needs as the widgets are complementary to the necessities as well as related to the improvements in that the improvements are complementary to the necessities and needs. And that the most important result reached in this research is a close relationship between conservation of the offspring and the purposes of the law, it is linked to the book and sunnah link branch to the origin because the origin of the purposes of the purposes of the book and the sunnah. |
