| المستخلص: | تعد الصفقات العمومية آلية لتدخل الدولة بهدف تقوية الاقتصاد ودفع المجتمع نحو التقدم، وبحكم أن هذه الآلية تحتاج لمبالغ ضخمة، وأنها عرضة للفساد بنسب كبيرة، فإنها بالمقابل تحتاج لتقويم مستمر مناطه الاعتماد على آليات رقابية فعالة، ومن أجل ذلك اقتنع المشرع الجزائري بوجوب تجريد إبرام الصفقات العمومية من صبغتها المادية وإقرار التعاملات الإلكترونية فيها. حيث أنه في 17- 11- 2013 صدر قرارا وزاريا لإنشاء البوابة الإلكترونية للصفقات العمومية يتضمن محتواها وكيفية تسييرها، فهي تحوي نظام مصمم يسمح بمبادلة المعلومات والوثائق إلكترونيا، وكذا إبرام الصفقات العمومية مع تأمينها وحمايتها، فبهذه الخاصية ستكرس الشفافية أكثر، وستضمن منافسة مشروعة، وحماية للمال العام، بالتالي وضع حد للفساد، فهو يعوق معدلات النمو الاقتصادي ويضعف الثقة في العمل، ويقوض من مكانة السلطة والإدارة في الدولة. ورغم الدور الهام الذي تلعبه البوابة الإلكترونية في مجال الصفقات العمومية وما تحويه من أنظمة أمنية، إلا أن الثغرات التي يحويها قانون الصفقات العمومية ستقلل من فاعلية البوابة، مع إصرار المتلاعبين على استغلال نقائص القانون والانحراف بالإجراءات، فتبقى الشفافية والنزاهة والثقة آمال فقط. Public transactions are a mechanism for state intervention with the strengthening the economy and pushing society towards progress, bat this mechanism requires huge amounts of money, and is subject to corruption in large proportions, it, in turn, needs continuous evaluation based on reliance on effective control mechanisms, and for this the Algerian legislator is convinced that the conclusion of the conclusion Public transactions of their physical nature and the approval of electronic transactions in them. As on 11-17-2013 it decised to establish the electronic portal for public deals that includes its content and how to manage it. It will ensure legitimate competition and protect public money, thus putting an end to corruption, as it impedes economic growth rates, weakens confidence in work. Despite the important role that the electronic portal plays in the field of public transactions and the security systems, bat the loopholes contained in the Public Transactions Law will reduce the effectiveness of the portal, with the insistence of manipulators to exploit the shortcomings of the law, so transparency, integrity and trust remain only hopes. |
