| المستخلص: | قام الفقه الحديث -اعتمادا على ما استقر عليه القضاء -بإرساء نظرة جديدة لمسؤولية المهنيين القانونيين، تخطت التقسيم التقليدي للمسؤولية المدنية، مؤكدا ذاتية المسؤولية المهنية وخصوصيتها من جهة، وقصور الأحكام السابقة وعدم كفايتها واحتوائها لكل الالتزامات القانونية من جهة ثانية. لذلك، ستعكف هذه الدراسة على تحديد وحصر مختلف الالتزامات المهنية المستحدثة من طرف القضاء المقارن، بالنظر لأهمية ذلك في تحقق إحدى شروط مساءلة المهنيين، خاصه وأن التشريعات قد تأثرت بذلك وأفردت المهنيين القانونيين بالتزامات مشتركة، ذات طبيعة خاصة، متسمة بنوع من الشدة والصرامة، مقارنة بباقي الالتزامات المقررة. بموجب القواعد العامة. Recent jurisprudence-depending on what the judiciary has settled-has established a new view of the responsibility of legal professionals. This new vision has passed the traditional division of civil responsibility. It stresses the independence of the professional responsibility and its specificity on the one hand, and the shortcomings of the previous provisions, their inadequacy, and encompassing all legal obligations on the other hand. Therefore, the present study will identify the various professional obligations created by the comparative judiciary. It strives to highlight the requirements for the accountability of professional especially, when legislation has been affected by this and has provided legal professionals with common obligations, of a special nature, of some severity and rigor, as compared to other obligations under the general rules |
