| 520 | |a المدونة أصل علم المالكية، اعتمدها أئمة المذهب واعتنوا بها، وكان من أوجه الاعتناء بها اختصارها وتهذيبها، ولذلك كانت هذه الدراسة لبيان المؤلفات في اختصارها، ومناهج ذلك الاختصار، وأثره الفقهي، وقد اشتركت هذه المختصرات في تقليل الألفاظ باستبدال صيغ السؤال والجواب بصيغ خبرية واضحة في بيان الحكم، وحذف الأحاديث والآثار، والتخلص من التكرار، وكان منهج بعضها اختصار الظواهر والالتزام بالألفاظ كابن شبلون، فيما ذهب ابن أبي زيد إلى منهج آخر بالاختصار بالمعنى والتكميل بما في الأمهات الأخرى للمذهب، هذا الاختلاف في المنهج كان له أثر في فهم المدونة، ولذلك وقع الخلاف في عدد من الفروع الفقهية. |b "AL MODAWANA is the origin of the MALIKI’s scholarly work corpus. It was greatly appreciated by the scholars of the madhab and many commends were actually written for that matter, hence the reason this study was put forth in an effort to identify the main abridgments of AL MODAWANA as well as the methodologies that were followed when writing these abridgments and their jurisprudential influence. They all share some notable commonalities such as ; -Proceeding by lessening the wordings (rewording the question-answer writing style to a statement sentence that straightforwardly elucidate the ruling ) -removing the narrations and the redundancies. Some writers chose to faithfully stick to the original wordings, the likes of IBN CHAPLAIN, where as others like IBN ABI ZAYD chose to summarize the overall meaning relying upon other major books of the madhab (AL OUMMAHAT) for completion of the meaning. The differences in the two approaches have had noteworthy impacts on the understanding of the MODAWANA, hence the differences of opinions in many branches of FIQH." | ||
