| المستخلص: | تناقش هذه الدراسة مسألة القتل الرحيم لكبار السن المصابين بفيروس كورونا، وذلك في ستة مباحث مسبوقة بمقدمة، ومختتمة بخاتمة. المقدمة: وفيها أهمية موضوع البحث، وأسباب اختياره، وأهداف الدراسة، كما تضمنت منهج البحث في الدراسة، والدراسات السابقة، وما تتميز به هذه الدراسة. أما عن المبحث الأول فقد جاء بعنوان: "حث الإسلام على التداوي ومعالجة الأمراض"، وتناول حرص التشريع الإسلامي بوسائل متعددة، كتشريع القصاص، وتحريم الانتحار، وتحريم قتل النفس بغير حق، كما تناول مجموعة الأحاديث النبوية الشريفة الحاثة على التداوي وطلب العلاج لمن أصيب بداء أو مرض. أما عن المبحث الثاني فقد جاء بعنوان: "احترام ورعاية الإسلام لحقوق المسنين وكبار السن"، وتضمن مجموعة الرخص الشرعية في بعض أبواب العبادات لأصحاب الأعذار، ومنهم: كبار السن، كما تضمن مجموعة الآداب الإسلامية الفاضلة التي يجب أن يتعامل بها المسلم مع كبار السن، وفقاً للآيات القرآنية والأحاديث النبوية. أما عن المبحث الثالث فقد جاء بعنوان: نشأة القتل الرحيم وصوره، وقد اشتمل على التعريف بالقتل الرحيم، وصوره، ونشأة فكرة القتل الرحيم وتطوره. أما عن المبحث الرابع فقد جاء بعنوان: "حكم القتل الرحيم لكبار السن المصابين بفيروس كورونا"، وقد اشتمل على تجدد فكرة القتل الرحيم، والمطالبة بتطبيقها على كبار السن المصابين بفيروس كورونا، كما اشتمل – أيضاً - على حكم القتل الرحيم لكبار السن المصابين بفيروس كورونا. أما عن المبحث الخامس فقد جاء بعنوان: "حكم التزاحم في العلاج وترتيب الأولوية فيه"، وتضمن مجموعة المرجحات الشرعية المعتبرة، والتي يعتمد عليها في تحديد الأَوْلى والأحق بتقديم العلاج له، وذلك حال تزاحم المرضى، وعدم وجود إمكانيات طبية متوفرة لإسعاف جميع المرضى. أما عن المبحث السادس فقد جاء بعنوان: "إعمال فقه المقاصد في معالجة النوازل والمستجدات"، وتناول فقه المقاصد وكيفية إعماله في مواجهة وباء كورونا. الخاتمة: وتضمنت أهم نتائج البحث، والتوصيات. This study discusses the issue of euthanasia for elderly people infected with the Corona virus, in six sections preceded by an introduction, and concluded with a conclusion.. Introduction: It includes the importance of the research topic, the reasons for choosing it, and the study's objectives. It also includes the research method in the study, previous studies, and what distinguishes this study.. As for the first topic, it came under the title: “Islam Urging Medicine to Treat Diseases,” and it dealt with the keenness of Islamic legislation through various means, such as the legislation of retribution, the prohibition of suicide, and the prohibition of unlawfully killing oneself. or disease.. As for the second topic, it came under the title: “Islam’s respect and care for the rights of the elderly and the elderly.” It included a set of legal licenses in some chapters of worship for those with excuses, including: the elderly. It also included a set of virtuous Islamic etiquette that a Muslim must deal with the elderly, According to Quranic verses and hadiths of the Prophet .As for the third topic, it was titled: “The Origin of Euthanasia and Its Images.” It included the definition of euthanasia, its forms, and the emergence and development of the idea of euthanasia .As for the fourth topic, it was titled: “The ruling on euthanasia for the elderly infected with the Corona virus”, and it included the renewal of the idea of euthanasia, and the demand to apply it to the elderly infected with the Corona virus .As for the fifth topic, it came under the title: “The ruling on overcrowding in treatment and the order of priority in it,” and it included a set of considered legal weights, which are relied upon in determining the first and the most deserving of treatment, in the event of crowding of patients, and the absence of medical capabilities available to help all patients.. As for the sixth topic, it came under the title: "Implementing the Fiqh of Maqasid in Addressing Calamities and Developments", and it deals with the Jurisprudence of Maqasid and how to implement it in the face of the Corona epidemic.. Conclusion: It included the most important results of the research, and recommendations. |
