| 520 | |a الحالات الاستثنائية ظرف غير اعتيادي، تمس بالحقوق والحريات تتوسع فيها سلطات رئيس الجمهورية لمواجهة هذا الظرف، وتضعف فيه سلطات البرلمان سواء من حيث سلطة التشريع أو الرقابة ويبقى دوره فقط سياسي، وهذا ما كرسه التعديل الدستوري 2020 على غرار ما عهدناه في التعديلات الدستورية السابقة، مع إدخال بعض التعديلات للتضييق من سلطة رئيس الجمهورية منها تحديد مدة حالة الطوارئ أو الحصار والحالة الاستثنائية، وخضوع قرارات رئيس الجمهورية التي اتخذها بعد نهاية مدة الحالة الاستثنائية لرقابة المحكمة الدستورية. |b The exceptional cases are an unusual circumstance, which touch rights and freedoms in which the authority of the president of the republic is extended to face this circumstance, and the parliamentary authority is weakened whether in the legislative authority or control, its role is only political, this is consecrated by the constitutional amendment 2020 like what we have seen in the precedent constitutional amendments, and the introduction of some amendments in order to restrict the president of the republic authority, including determining the period of the emergency case or the siege and the exceptional case, and to subject the decisions of the president of the republic which he has taken after the end of the exceptional case to the constitutional tribunal in order to control it. | ||
