| المستخلص: | يبرز لنا هذا البحث الأحاديث المرفوعة المتعارضة في كتاب النكاح من مصنف ابن أبي شيبة متناولا تلك الأحاديث التي يبدو في ظاهرهما الاختلاف والتعارض والتضاد باحثا ومجتهدا في إمكان الجمع بينها، وذلك ببيان العام والخاص، أو المطلق والمقيد، أو ما شابه ذلك، أو بيان الناسخ من المنسوخ، أو بترجيح بعض الأحاديث على بعض إن تعذر الجمع، وخفي منها السابق واللاحق، ثم يجلي البحث آراء الفقهاء في المسألة ومذاهبهم مرجحا بينها إن ظهر شيء من وجوه الترجيح. This research highlights to us the contradictory transmitted hadiths in the Book of Marriage from Ibn Abi Shaybah’s workbook, addressing those hadiths that seem on the surface of difference, contradiction and contradiction, searching and striving for the possibility of combining them, and that is with the statement of the absolute or the general and the restricted, The abrogator is from the abrogated, or by giving preference to some hadiths over others if the combination is not possible, and the previous and subsequent ones are hidden. the research clarifies the opinions of the fuqaha’ on the issue and their doctrines, weighing between them if of the preponderances appeared. |
