| 520 | |a إن دور القضاء الدستوري لا يقتصر فقط على دعم الحقوق والحريات السياسية المرتبطة بصحة تكوين ونزاهة السلطة التشريعية، وإنما يمتد أيضاً ليشتمل دعم صحة وتكوين نزاهة السلطة الرئاسية، من خلال الرقابة الدستورية على نزاهة العملية الانتخابية الرئاسية وأيضاً محاكمة الرئيس في حالة الخيانة العظمى. فعلاقه القضاء الدستوري بالسلطات السياسية في الدولة علاقة وثيقة، من حيث أنه يطبق التشريع، وهو أداة تحقيق العدالة والأقدر على استظهارها في بعض الأحيان، في رحلة تطبيق التشريع والكشف عن الثغرات التي يمكن أن تختبئ ضمن العملية التشريعية. فقد أبيح للقاضي الدستوري أن يعلن في أحكامه ما ينتاب التشريع من نقص أو تناقض، بل أن القاضي الدستوري مباح له أن يصدر حكمه استناداً إلى مبادئ العدل والإنصاف إذا أعياه البحث في القانون، ولطالما طال البحث عن هيئة تتوافر فيها مقومات الحياد والنزاهة والاستقلال، هيئة لا تتلقى الأوامر والتعليمات من أي جهة أخرى، وقد يكون لها مصلحة في التأثير على العملية الانتخابية مثلاً أو غيرها من القضايا المطروحة والداخلة في اختصاصها، وهنا يكمن القول إنه لا يمكن لأي جهة النهوض بهذه المهام إلا القضاء الدستوري. |b The role of the constitutional judiciary is not only limited to supporting political rights and freedoms related to the correct formation and integrity of the legislative authority, but also extends to support the health and integrity of the presidential authority, through constitutional monitoring of the integrity of the presidential electoral process and also to try the president in case of high treason. The relationship of the constitutional judiciary with the political authorities in the state is a close relationship, in that it applies legislation, which is a tool for achieving justice and is able to memorize it in some cases, in the journey of implementing legislation and uncovering loopholes that may hide within the legislative process. The constitutional judge was permitted to declare in his rulings the deficiency or contradiction in the legislation. Rather, the constitutional judge is permitted to issue his judgment based on principles of justice and fairness if he is exhausted by researching the law, and the search for a body that has the elements of impartiality, integrity and independence has long been sought. She receives orders and instructions from any other party, and it may have an interest in influencing the electoral process, for example, or other issues raised and within its competence, and here lies the saying that no party can undertake these tasks except the constitutional judiciary | ||
