| المستخلص: | إن مدرسة بغداد الفقهية إحدى كبريات مدارس الفقهي الإمامي التي تفرعت عن مدرسة أهل البيت صلوات الله عليهم أجمعين، والتأصيل الفقهي-في إطاره النظري في مدون مستقل عن الفقه-فقهاؤها هم من شيدوا بنيانه والمنهج التكاملي الذي جمع بين العقل والنقل هم بناته، ومن جاء من الأصوليين بعدهم سار على هذا المنهج منذ ذلك الوقت حتى يومنا هذا. وعلى أيديهم تمت المحاولات الأولى لفصل الأبحاث الأصولية عن الأبحاث العقائدية-أصول الدين-والأبحاث الفقهية، وإن تثليث الأصول الاجتهادية: (الكتاب، السنة، والإجماع) منهم صدر-لأن عصر النص لم يعهد سوى الكتاب والسنة؛ بوصفهما مصدرين للحكم الشرعي، نعم تبنى الفقهاء بعض القواعد الأصولية المستقاة منهما وجرى التفريع عليها بعد إلقائها من أئمة أهل البيت صلوات الله عليهم أجمعين وندبهم للتفريع عليها ولكن في حدود بدائية بسيطة-وهو معتمد إلى يومنا هذا يمثل المرحلة الأولى من مراحل الاجتهاد التي تنتج الحكم الواقعي، أما الأصل الاجتهادي الرابع العقل، فهم تعرضوا إلى ذكره في الجانب التطبيقي الفقهي، وصرحوا بالرجوع إليه عند تعذر الأصول الثلاثة المذكورة آنفا، إلا أنهم أغفلوا ذكره في النظرية الأصولية عند حصر الأصول الاجتهادية عندهم.
